A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, TO CREATE A STUDY COMMITTEE TO STUDY APPROPRIATE ENFORCEMENT OF FEDERAL AND STATE LAWS RELATING TO THE PRESENCE OF ILLEGAL ALIENS IN THIS STATE AND TO RECOMMEND LEGISLATIVE CHANGES AS APPROPRIATE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    (A)    There is created a Study Committee to study the appropriate enforcement of federal and state laws relating to the presence of illegal aliens in this State and to recommend legislative changes as appropriate.

(B)    The Study Committee must be composed of nine members appointed as follows:

(1)    three members of the House of Representatives appointed by the Speaker of the House of Representatives;

(2)    three members of the Senate appointed by the President Pro Tempore of the Senate;

(3)    the Attorney General or his designee;

(4)    one member appointed by the Governor who must be a sheriff recommended by the South Carolina Sheriffs' Association; and

(5)    the chief of the State Law Enforcement Division or his designee.

(C)    The Study Committee shall render its report and recommendations to the Speaker of the House of Representatives, the President Pro Tempore of the Senate, and the Governor no later than January 1, 2008. The Study Committee shall continue to meet after this date, if necessary, in order to make continuing recommendations to the General Assembly regarding the appropriate enforcement of federal and state laws related to the presence of illegal aliens in the State.

SECTION    2.    This act takes effect upon approval by the Governor.
