TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 44-95-70 SO AS TO PROVIDE THAT A COUNTY OR MUNICIPALITY BY ORDINANCE MAY PROHIBIT SMOKING IN DESIGNATED LOCATIONS WITHIN ITS JURISDICTION AND TO PROVIDE FOR THE PENALTIES WHICH APPLY FOR VIOLATION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 95, Title 44 of the 1976 Code, is amended by adding:
"Section 44-95-70. Notwithstanding the provisions of this chapter, a county or municipality by ordinance may prohibit smoking in designated locations within its jurisdiction. Penalties for violating the ordinance must be those contained in Section 44-95-50."
SECTION 2. This act takes effect upon approval by the Governor.
