A HOUSE RESOLUTION

TO ESTABLISH A STUDY COMMITTEE TO REVIEW CHILD ABUSE INVESTIGATIONS AND INVESTIGATION PROCEDURES AND TO REPORT ITS FINDINGS AND MAKE RECOMMENDATIONS TO THE HOUSE OF REPRESENTATIVES.

Be it resolved by the South Carolina House of Representatives that, by this resolution, there is established the House Study Committee on Child Abuse to be composed of nine members of the House of Representatives who must be appointed by the Speaker of the House of Representatives. The committee shall review the Department of Social Services child abuse investigation procedures and shall specifically review a random sampling of such investigations conducted by the Department of Social Services. The committee also shall review the protections and immunities granted under the South Carolina Tort Claims Act to the Department of Social Services and to state employees who engage in conducting, supervising, and overseeing such investigations and shall consider whether certain conduct engaged in during these investigations, including, but not limited to, abuse of power, malice, and recklessness, should receive such protection and immunity and whether such conduct should be referred for prosecution. The committee shall report its findings and make recommendations to the House of Representatives, at which time the study committee is abolished.

Be it further resolved that the South Carolina Department of Social Services shall cooperate with and assist the study committee in carrying out its duties under this resolution.
