TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-1-183, SO AS TO PROVIDE THAT A PERSON WHO IS INELIGIBLE TO OBTAIN A DRIVER'S LICENSE OR A DRIVER'S PERMIT MAY NOT OPERATE AN ALL-TERRAIN VEHICLE, AND TO PROVIDE A PENALTY FOR A VIOLATION OF THIS PROVISION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 1, Chapter 1, Title 56 of the 1976 Code is amended by adding:
"Section 56-1-183. (A) Notwithstanding another provision of law, a person who is ineligible to obtain a driver's license or a driver's permit may not operate an all-terrain vehicle.
(B) The vehicle operated by a person who violates this section must be confiscated by and forfeited to the law enforcement agency that issues a citation for a violation of this section."
SECTION 2. This act takes effect upon approval by the Governor.
