To whom was referred a Bill (S. 43) to amend the Code of Laws of South Carolina, 1976, by adding Section 24-21-435 so as to provide that a sex offender who is serving a probationary sentence, etc., respectfully
That they have duly and carefully considered the same and recommend that the same do pass with amendment:
Amend the bill, as and if amended, by striking all after the enacting words and inserting:
/ SECTION 1. Article 5, Chapter 21, Title 24 of the 1976 Code is amended by adding:
"Section 24-21-435. A person who is determined to be a sex offender pursuant to Section 23-3-430, who is serving a probationary sentence, and has been determined by the Department of Probation, Parole and Pardon Services to pose a great risk of becoming a recidivist, or has been convicted of a second offense pursuant to Section 23-3-430, must be placed under global positioning system satellite surveillance continuously for the duration of his probationary sentence by the department."
SECTION 2. This act takes effect upon approval by the Governor and implemented upon the appropriation of sufficient funds by the General Assembly. /

EXPLANATION OF IMPACT:
Department of Probation, Parole and Pardon Services (PPP)
The department indicates this bill will have a net impact on the General Fund of the State of approximately $2,976,672 in recurring cost and $203,463 in non-recurring cost for a total of $3,180,135. Section 24-21-80 and 24-21-85 of the Code of Laws allow PPP to collect a fee from those individuals who are on electronic monitoring to help offset the cost of the monitoring. The department anticipates collecting $1,123,200 (based on $40 per week and a 60% collection rate) in revenue to offset the cost of implementation. Cost estimates are summarized below based on a 900 offenders.

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 24-21-435 SO AS TO PROVIDE THAT A SEX OFFENDER WHO IS SERVING A PROBATIONARY SENTENCE MUST BE PLACED UNDER GLOBAL POSITIONING SYSTEM SATELLITE SURVEILLANCE CONTINUOUSLY FOR THE DURATION OF HIS PROBATIONARY SENTENCE BY THE DEPARTMENT OF PROBATION, PAROLE AND PARDON SERVICES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 5, Chapter 21, Title 24 of the 1976 Code is amended by adding:
"Section 24-21-435. A person who is determined to be a sex offender pursuant to Section 23-3-430 and who is serving a probationary sentence must be placed under global positioning system satellite surveillance continuously for the duration of his probationary sentence by the department."
SECTION 2. This act takes effect upon approval by the Governor.
