A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-5-2595 SO AS TO REGULATE THE USE OF PARKING METERS WHEN THEY ARE LOCATED WITHIN A CERTAIN DISTANCE OF AN INSTITUTION OF HIGHER LEARNING OR A GOVERNMENT BUILDING AND TO PROVIDE A PENALTY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 19, Chapter 5, Title 56 of the 1976 Code is amended by adding:

"Section 56-5-2595.    (A)    For purposes of this section:

(1)    'Institution of higher learning' is as defined in Section 59-154-10(A)(1).

(2)    'Governmental buildings' is as defined in Section 10-5-220(1).

(B)    It is unlawful for a municipality that installs devices to meter parking for motor vehicles located within one-fourth mile from an institution of higher learning or a government building to charge more than twenty-five cents an hour. This meter must allow a person to park at that meter for a duration of at least three hours.

(C)    The fine for an expired meter may not exceed two dollars for a twenty-four hour period.

(D)    Notwithstanding the provisions of Section 6-27-40, a municipality violating the provisions of this section shall forfeit its distribution of state aid to subdivisions for the fiscal year in which the violation occurs."

SECTION    2.    This act takes effect upon approval by the Governor.
