A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 7-13-615 SO AS TO PROVIDE A PLACE ON A PRIMARY BALLOT FOR WRITE-IN NAMES; AND TO AMEND SECTION 7-13-360, AS AMENDED, RELATING TO WRITE-IN BALLOTS IN GENERAL ELECTIONS, SO AS TO DELETE THE PROHIBITION OF A WRITE-IN SPACE FOR THE ELECTION OF PRESIDENT AND VICE PRESIDENT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 5, Chapter 13, Title 7 of the 1976 Code is amended by adding:

"Section 7-13-615.    Notwithstanding the provisions of this chapter, ballots used in a primary election also must contain a place for voters to write in the name of another for whom they wish to vote."

SECTION    2.    Section 7-13-360 of the 1976 Code, as last amended by Act 419 of 1982, is further amended to read:

"Section 7-13-360.    The ballots shall also must contain a place for voters to write in the name of any other another person for whom they wish to vote except on ballots for the election of the President and Vice President."

SECTION    3.    This act takes effect upon approval by the Governor.
