TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-5-2600 SO AS TO PROVIDE A PROCEDURE WHEREBY A LOCAL GOVERNING AUTHORITY MAY COLLECT FINES ASSOCIATED WITH PARKING CITATIONS ISSUED TO VEHICLE OWNERS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 19, Chapter 5, Title 56 of the 1976 Code is amended by adding:
"Section 56-5-2600. (A) A local governing authority that has issued an unsatisfied citation for a vehicle registered in this State that has violated a provision that regulates the parking of vehicles must give the vehicle's owner three written notices that his vehicle has an outstanding parking citation pending against him before it may request that the Department of Motor Vehicles not renew its registration until the citation is satisfied. The citation is the first notice. The fines may be increased pursuant to the schedule of fines approved by the governing authority. If the citation remains unsatisfied more than eight days after its issuance, then a second written notice must be sent to the registered owner of the vehicle.
(B) If the citation remains outstanding for at least sixty days, the governing authority also may notify the vehicle's registered owner that it may notify the Department of Motor Vehicles of the outstanding citation and request that the department not renew the vehicle's registration until the citation is satisfied. This notification constitutes the third written notice.
(C) If the citation remains outstanding more than thirty days after the second written notice is sent to the vehicle's registered owner, then the governing body may notify the Department of Motor Vehicles that it holds an outstanding parking violation citation against the vehicle. Once the department receives this notification, it may not issue to the vehicle's owner a new vehicle registration, license plate, or renewal sticker until the parking citation has been satisfied and all fines associated with the citation have been paid. The department must place all fines collected pursuant to this subsection in a special account and distribute them to the governing authority that issued the citation.
(D) The second and third written notices must be sent to the last address of record associated with the vehicle's owner."
SECTION 2. This act takes effect upon approval by the Governor.
