TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 11-35-52 SO AS TO PROHIBIT A GOVERNMENTAL BODY SUBJECT TO THE CONSOLIDATED PROCUREMENT CODE FROM ENTERING INTO A CONTRACT OF PURCHASE WITH A VENDOR LOCATED IN OR OTHERWISE OPERATING IN A FOREIGN COUNTRY WITHOUT FIRST HAVING GIVEN A UNITED STATES RESIDENT VENDOR THE OPPORTUNITY TO BE AWARDED THE CONTRACT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 1, Chapter 35, Title 11 of the 1976 Code is amended by adding:
"Section 11-35-52. A governmental body subject to the Consolidated Procurement Code procuring goods or services or information technology may not enter into a contract of purchase with a vendor located in or otherwise operating in a foreign country without first having given a United States resident vendor the opportunity to be awarded the contract."
SECTION 2. This act takes effect upon approval by the Governor.
