EXPLANATION OF IMPACT:

This bill would have no impact on the General Fund of the State or federal and/or other funds. The bill modifies the process by which members of the Consumer Affairs Commission are elected and qualified by the General Assembly.

A BILL

TO AMEND SECTION 37-6-502, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO SELECTION OF MEMBERS OF THE COMMISSION ON CONSUMER AFFAIRS, SO AS TO PROVIDE FOR THE ELECTION EVERY FOUR YEARS OF THE COMMISSIONERS ELECTED BY THE GENERAL ASSEMBLY BEGINNING FEBRUARY 1, 2008.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 37-6-502 of the 1976 Code is amended to read:

"Section 37-6-502.    The Commission on Consumer Affairs shall be is composed of nine members, one of whom shall be the Secretary of State as an serving ex officio member;, four members shall be appointed by the Governor with advice and consent of the Senate, and the remaining four members shall be elected by the General Assembly. Members of the commission shall elect a chairman. Terms The term of the members shall be a member is four years unless otherwise stipulated in this section., and Upon the expiration of the terms, the Governor shall appoint a member to replace an appointed member and the General Assembly shall elect one a member to replace an elected member respectively, except that a member who is elected by the General Assembly serves four years and until a successor is elected and qualified, commencing on February 1, 2008. With the exception of the ex officio member, any a vacancy in the office of a member shall must be filled by the Governor by appointment for the unexpired term. Members A member of the commission shall be is eligible for reappointment or reelection. No A person associated with any businesses a business regulated by the Commission on Consumer Affairs, as defined by Section 8-13-100, shall be is not eligible to serve on the commission as defined by Section 8-13-20 of the Code of Laws of South Carolina."

SECTION    2.    This act takes effect upon approval by the Governor, with the first elected members pursuant to this act to begin their terms February 1, 2008.
