TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-5-6205 SO AS TO PROVIDE A DEFINITION FOR THE TERM "DUI INTERVENTION TEAM" AND TO PROVIDE THAT A LAW ENFORCEMENT AGENCY SHALL RECEIVE ALL FINES THAT ARE ASSESSED AGAINST A PERSON WHO IS ARRESTED BY THE LAW ENFORCEMENT AGENCY'S DUI INTERVENTION TEAM FOR CERTAIN OFFENSES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 43, Chapter 5, Title 56 of the 1976 Code is amended by adding:
"Section 56-5-6205. (A) As used in this section, 'DUI Intervention Team' means a law enforcement agency's unit that consists of officers who receive overtime compensation to operate driver's license checkpoints.
(B) Notwithstanding another provision of law, a law enforcement agency shall receive all fines that are assessed against a person who is arrested by the law enforcement agency's DUI Intervention Team for a violation of any provision that makes it illegal for a person to operate a motor vehicle while under the influence of alcohol, drugs, or any other substance."
SECTION 2. This act takes effect upon approval by the Governor.
