TO ENACT "THE SOUTH CAROLINA ACCOUNTABILITY IN GOVERNMENT ACT OF 2010" BY ADDING SECTION 8-13-776, CODE OF LAWS OF SOUTH CAROLINA, 1976 SO AS TO PROVIDE THAT NO STATE OR LOCAL PUBLIC OFFICIAL, OR HIS SPOUSE, CHILDREN, MEMBERS OF HIS IMMEDIATE FAMILY, OR ANY BUSINESS OR ENTITY WITH WHICH THEY ARE ASSOCIATED, MAY ENTER INTO A CONTRACT TO PROVIDE GOODS OR SERVICES TO THE STATE OR LOCAL JURISDICTION OF WHICH HE IS A PUBLIC OFFICIAL, WHETHER OR NOT HE AS A PUBLIC OFFICIAL HAS A DIRECT ROLE IN PREPARING THE CONTRACT; AND BY ADDING SECTION 8-13-1121 SO AS TO PROVIDE THAT BEGINNING WITH THE 2010 STATEMENTS OF ECONOMIC INTEREST FILED BY MEMBERS OF THE GENERAL ASSEMBLY, THE DUE DATE FOR FILING IS THE TENTH DAY OF JANUARY, AND MUST REFLECT ALL TRANSACTIONS REQUIRED TO BE REPORTED WHICH OCCURRED IN THIS PREVIOUS CALENDAR YEAR, AND TO PROVIDE BEGINNING WITH THE 2010 STATEMENTS OF ECONOMIC INTEREST FILED BY MEMBERS OF THE GENERAL ASSEMBLY, ALL SOURCES OF EARNED INCOME ALSO MUST BE REPORTED WHETHER OR NOT DERIVED FROM PUBLIC OR PRIVATE SOURCES, AND IF THE MEMBER RECEIVES FEE OR RETAINER INCOME FOR PROFESSIONAL SERVICES RENDERED, THIS FEE OR RETAINER INCOME MUST BE SEPARATELY ITEMIZED BY CLIENT NAME AND AMOUNT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. This act is known and may be cited as the "South Carolina Accountability in Government Act of 2010".
SECTION 2. Article 7, Chapter 13, Title 8 of the 1976 Code is amended by adding:
"Section 8-13-776. (A) On the effective date of this section, no state or local public official, or his spouse, children, members of his immediate family, or any business or entity with which they are associated, may enter into a contract to provide goods or services to the state or local jurisdiction of which he is a public official, whether or not he as a public official has a direct role in preparing the contract as provided in Section 8-13-775.
(B) Any contract for a stated term entered into prior to the effective date of this section which would otherwise be prohibited by the provisions of this section nevertheless remains valid until the expiration of its stated term."
SECTION 3. Article 11, Chapter 13, Title 8 of the 1976 Code is amended by adding:
"Section 8-13-1121. (A) Beginning with the 2010 statements of economic interest filed by members of the General Assembly, the due date for filing is the tenth day of January, and must reflect all transactions required to be reported which occurred in the previous calendar year.
(B) Beginning with the 2010 statements of economic interest filed by members of the General Assembly, all sources of earned income also must be reported whether or not derived from public or private sources, and if the member receives fee or retainer income for professional services rendered including from those occupations requiring licensure by the State of South Carolina, this fee or retainer income must be separately itemized by client name and amount."
SECTION 4. This act takes effect upon approval by the Governor.
