A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-3-1065 SO AS TO PROVIDE THAT IT IS UNLAWFUL FOR A PERSON TO FLEE FROM A LAW ENFORCEMENT OFFICER UNDER CERTAIN CIRCUMSTANCES, AND TO PROVIDE A PENALTY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 11, Chapter 3, Title 16 of the 1976 Code is amended by adding:

"Section 16-3-1065.    (A)    In the absence of mitigating circumstances, it is unlawful for a person to flee from a law enforcement officer when the person is:

(1)    approached by a law enforcement officer; or

(2)    in the presence of a law enforcement officer.

(B)    A person who violates this provision is guilty of a misdemeanor and, upon conviction, must be imprisoned not more than ninety days."

SECTION    2.    This act takes effect upon approval by the Governor.
