The House assembled at 11:00 a.m.
Deliberations were opened with prayer by Rev. Charles E. Seastrunk, Jr., as follows:
Our thought for today is from Proverbs 2:10-11: "For wisdom will come into your heart and knowledge will be pleasant to your soul; prudence will watch over you; and understanding will guard you."
Let us pray. Eternal Father God, during this week, when the way is hard and the hours long, we implore You to be our helper, who never leaves or forsakes us. Remind us of Your nearness, Your faithfulness, and Your strength, for the task ahead. Give us the courage of our convictions to do the right thing for the right reason. Help us to remember those who are needful. Give us Your blessings and peace. Bless our Nation, State, and all who lead and guide us in our duties. Protect our defenders of freedom at home and abroad, as they protect us. Heal the wounds, those seen and those hidden, of our brave warriors. Lord, in Your mercy, hear our prayer. Amen.

I inadvertently voted on Section 60, the Patients Compensation Fund, during the debate on Part 1A of H. 4813, the General Appropriation Bill. I have a potential conflict of interest that may exist in that an economic interest I have may be affected. I did not intend to vote on Section 60, I meant to abstain from the vote.

Rep. WHITE moved that the House recede until 2:00 p.m., which was agreed to.
Further proceedings were interrupted by the House receding, the pending question being consideration of the Bill.
At 2:00 p.m. the House resumed, ACTING SPEAKER PUTNAM in the Chair.
The question of a quorum was raised.
A quorum was later present.
Debate was resumed on the following Bill, the pending question being the consideration of Part IA:
Reps. BRANNON and SELLERS proposed the following Amendment No. 3 (Doc Name h:\legwork\house\amend\H-WM\004\EFA FUNDING INCREASE.DOCX), which was ruled out of order:
Amend the bill, as and if amended, Part IA, Section 1, DEPARTMENT OF EDUCATION, page 11, line 33, opposite /Education Finance Act/ by increasing the amount(s) in Columns 3 and 4 by:
Column 3 Column 4
438,267,074 438,267,074
Renumber sections to conform.
Amend totals and titles to conform.
Rep. BRANNON explained the amendment.
Rep. BINGHAM raised the Point of Order that Amendment No. 3 was out of order because it appropriated more than 5 million dollars but did not state in writing where the corresponding reductions in the Bill would occur to fund the increased revenue for the Education Finance Act.
Rep. BRANNON spoke to the Point of Order stating that he had verbally explained that the monies were coming from all new revenues as projected by the Board of Economic Advisors.
SPEAKER HARRELL stated that Rule 5.3B mandated that the amendment specifically state or have attached to it in writing an explanation of the corresponding reductions that fully fund the appropriation in the amendment. The SPEAKER stated that Amendment No. 3 failed to satisfy this requirement. Thus, he sustained the Point of Order and ruled the amendment out of order.
Rep. WILLIAMS proposed the following Amendment No. 40 (Doc Name COUNCIL\DKA\4014SD12.DOCX), which was ruled out of order:
Amend the bill, as and if amended, Part IA, Section 1, DEPARTMENT OF EDUCATION, page 11, line 33, opposite /Education Finance Act/ by increasing the amount(s) in Columns 3 and 4 by:
Column 3 Column 4
338,394,320 338,394,320

Rep. BINGHAM raised the Point of Order that Amendment No. 40 was out of order because it appropriated more than 5 million dollars but did not state in writing where the corresponding reductions in the Bill would occur to fund the increased revenue for the Education Finance Act.
Rep. WILLIAMS spoke to the Point of Order stating he felt that the funds would come from the Capital Reserve Fund, which is part of the Budget.
SPEAKER HARRELL stated that Rule 5.3B mandated that the amendment specifically state or have attached to it in writing an
explanation of the corresponding reductions that fully fund the appropriation in the amendment. The SPEAKER stated that Amendment No. 40 failed to satisfy this requirement. Thus, he sustained the Point of Order and ruled the amendment out of order.
