A BILL

TO AMEND ACT 510 OF 1982, AS AMENDED, RELATING TO THE ANDERSON COUNTY BOARD OF EDUCATION, SO AS TO REAPPORTION THE DISTRICTS FROM WHICH BOARD MEMBERS ARE ELECTED; AND TO AMEND ACT 509 OF 1982, AS AMENDED, RELATING TO THE ELECTION OF TRUSTEES OF THE FIVE ANDERSON COUNTY SCHOOL DISTRICTS, SO AS TO REAPPORTION THESE DISTRICTS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 1(A) of Act 510 of 1982, as last amended by Act 402 of 2002, is further amended to read:

"(A)(1)    Notwithstanding any other provision of law, beginning with vacancies filled at the election conducted in 2002 2014, the nine defined single-member election districts from which each member of the Anderson County Board of Education must be elected by the qualified electors of that district are as shown defined on the official map designated as S-07-00-02 S-07-00-14 prepared by and on file with the Office of Research and Statistical Services Statistics of the State Budget and Control Board.

(2)    The demographic information shown on this map is as follows:

SECTION    2.    Act 509 of 1982, as last amended by Act 347 of 2004, is further amended by adding a new section to read:

"Section 13A.    (A)(1)    Notwithstanding any other provision of law, beginning with school trustee elections in 2014, vacancies on the seven-member governing body of Anderson County School District 1 must be filled in the manner provided by law from the seven numbered single-member districts as defined on Anderson County School District 1 map S-07-01-14 as maintained in the Office of Research and Statistics of the State Budget and Control Board. A candidate must reside in the specific numbered district for which the candidate files for election. Each of the seven members must be elected by the qualified electors of all of Anderson County School District 1 with the winner for each numbered district determined by plurality vote.

(2)    The demographic information shown on this map is as follows:

(3)    The boundaries of Anderson County School District 1 are not altered by the provisions of this subsection. These school district lines are as defined by law and any census blocks which may be divided are done so only for statistical purposes and to establish a population base.

(B)(1)    Notwithstanding any other provision of law, beginning with the school trustee elections in 2014, vacancies on the seven-member governing body of Anderson County School District 2 must be filled in the manner provided by law as follows:

(a)    two members each from Districts 1 and 2 and one member each from Districts 3 and 4, the numbered districts being as defined on Anderson County School District 2 map S-07-02-14, as maintained in the Office of Research and Statistics of the State Budget and Control Board; and

(b)    one member elected from Anderson County School District 2 at large.

A candidate for a numbered district seat must reside in the district for which the candidate files for election. Each of the seven members must be elected by the qualified electors of all of Anderson County School District 2 with the winners from each numbered district seat and the at-large seat determined by plurality vote.

(2)    The demographic information shown on this map is as follows:

(C)(1)    Notwithstanding any other provision of law, beginning with the school trustee elections in 2014, vacancies on the five-member governing body of Anderson County School District 3 must be filled in the manner provided by law as follows:

(a)    one member each from the four numbered districts as defined on Anderson County School District 3 map S-07-03-14, as maintained in the Office of Research and Statistics of the State Budget and Control Board; and

(b)    one member elected from Anderson County School District 3 at large.

A candidate for a numbered district seat must reside in the district for which the candidate filed for election. Each of the members of the five members must be elected by the qualified electors of all of Anderson County School District 3 with the winners from each numbered district seat and the at-large seat determined by plurality vote.

(2)    The demographic information shown on this map is as follows:

(D)(1)    Notwithstanding any other provision of law, beginning with the school trustee elections in 2014, vacancies on the five-member governing body of Anderson County School District 4 must be filled in the manner provided by law, one member each from the five single-member districts as defined on Anderson County School District 4 map S-07-04-14, as maintained in the Office of Research and Statistics of the State Budget and Control Board.

A candidate must reside in the numbered single-member district for which the candidate files for election. The member must be elected by the qualified electors of the numbered district of Anderson County School District 4, with the winner determined by a plurality vote.

(2)    The demographic information shown on this map is as follows:

(3)    The boundaries of Anderson County School District 4 are not altered by the provisions of this subsection. These school district lines are as defined by law and any census blocks which may be divided are done so only for statistical purposes and to establish a population base.

(E)(1)    Notwithstanding any other provision of law, beginning with school trustee elections in 2014, vacancies on the nine-member governing body of Anderson County School District 5 must be filled in the manner provided by law as follows:

(a)    one member elected from each of the seven single-member districts defined on Anderson County School District 5 map as maintained in the Office of Research and Statistics of the State Budget and Control Board; and

(b)    two members elected at large from Anderson County School District 5.

A candidate for a numbered district seat must reside in the single-member district for which the candidate files for election. These members must be elected by the qualified electors of the specific numbered district of Anderson County School District 5, with the winner determined by a plurality vote. The two at-large members must reside in Anderson County School District 5 when they file for election and must be elected by the qualified electors of Anderson County School District 5, with the winner determined by plurality vote. All members shall serve for terms of four years and until their successors are elected and qualify.

(2)    The demographic information on the map is as follows:

SECTION    3.    This act takes effect upon approval by the Governor.
