TO AMEND SECTION 56-3-790, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE ISSUANCE OF LICENSE PLATES BY THE DEPARTMENT OF MOTOR VEHICLES TO CHARTERED VOLUNTEER RESCUE LEAGUES FOR MOTOR VEHICLES OWNED AND OPERATED FOR RESCUE WORK WITHOUT CHARGE, SO AS TO REVISE THIS PROVISION TO ALLOW THE DEPARTMENT TO ISSUE A NONPROFIT OR FOR PROFIT RESCUE LICENSE PLATE TO A RESCUE ENTITY OR BUSINESS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 56-3-790 of the 1976 Code is amended to read:
"Section 56-3-790. The Department of Motor Vehicles shall issue a license upon the payment of a five dollar fee to any chartered volunteer rescue league in this State for any motor vehicle owned and operated by it solely for rescue work without charge. (A) As used in this section 'Rescue Vehicle' means vehicles equipped with all of the safety equipment required by the Department of Health and Environmental Control or Department of Labor, Licensing and Regulation to be designated as either an ambulatory vehicle, or first responder fire vehicle, equipped with all the proper light and sound alert devices, and having the sole purpose of responding to emergency situations.
(B) Upon application and payment of the required fee, the Department of Motor Vehicles shall issue a nonprofit or for profit rescue license plate to a rescue entity or business. The license plates must be used exclusively on rescue vehicles as defined in subsection (A).
(C) Applications for rescue license plates must be made by a rescue entity or business on a form prescribed by the Department of Motor Vehicles and must be submitted with proof of the applicant's status as a bona fide rescue entity or business. The entity's governing agency shall indicate further the for profit or nonprofit status by its governing agency.
(D) The cost of each nonprofit rescue license plate is ten dollars, of which ten dollars maybe retained by the Department of Motor Vehicles to defray its cost. The cost of a for profit rescue license plate is forty dollars, of which twenty dollars maybe retained by the Department of Motor Vehicles to defray its cost and the remaining twenty dollars must be remitted to the general fund. Each license plate is valid for two years.
(E) The specially designated license plates issued pursuant to this section must be surrendered to the Department of Motor Vehicles upon expiration of operations by the registered
(F) Nothing in this section may be construed as affecting the license and registration fees to be paid on the vehicle involved, nor in any way to otherwise release the owners from complying with all provisions of the law relating to the licensing and registration of vehicles in South Carolina."
SECTION 2. This act takes effect upon approval by the Governor.
