TO REPEAL SECTION 6 OF ACT 114, RELATED TO THE TERMINATION OF THE GOVERNOR'S AUTHORITY TO APPOINT THE SECRETARY OF TRANSPORTATION; AND TO EXTEND THE GOVERNOR'S AUTHORITY UNTIL FURTHER ACTION BY THE GENERAL ASSEMBLY TO THE CONTRARY.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Act 114 of 2007 contained a broad range of reforms that transformed the operations of the Department of Transportation. Among the most important reforms contained in Act 114 was providing the Governor with the authority to appoint the Secretary of Transportation. SECTION 6 of Act 114 provided that the appointment power provided to the Governor would terminate and devolve to the Department of Transportation Commission on July 1, 2015, if the General Assembly did not extend the Governor's authority prior to that date.
SECTION 2. SECTION 6 of Act 114 of 2007, related to the termination of the Governor's authority to appoint the Secretary of Transportation, is repealed.
SECTION 3. The Governor's authority to appoint the Secretary of Transportation pursuant to Act 114 of 2007 is, by this act of the General Assembly, extended until further action by the General Assembly to the contrary.
SECTION 4. This joint resolution takes effect upon approval by the Governor.
