VERSIONS OF THIS BILL
PROPOSING AN AMENDMENT TO SECTION 8, ARTICLE XVII OF THE CONSTITUTION OF SOUTH CAROLINA, 1895, RELATING TO THE PROHIBITION OF PUBLIC OFFICERS GAMBLING OR BETTING ON GAMES OF CHANCE, SO AS TO PROVIDE AN EXCEPTION THAT ALLOWS PARTICIPATION IN LOTTERIES CONDUCTED BY THE STATE OF SOUTH CAROLINA BY PUBLIC OFFICERS OTHER THAN CERTAIN NAMED OFFICEHOLDERS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. It is proposed that Section 8, Article XVII of the Constitution of this State be amended to read:
"Section 8. It shall be is unlawful for any a person holding an office of honor, trust, or profit to engage in gambling or betting on games of chance; and any such an officer, upon conviction thereof of gambling or betting on games of chance, shall become is thereby disqualified from the further exercise of the functions of his office, and the office of said the convicted person shall become becomes vacant, as in the case of resignation or death. This prohibition does not apply to participation in lotteries conducted by the State of South Carolina; except that the following officeholders may not participate in lotteries conducted by this State: Governor, Lieutenant Governor, other constitutional officers, members of the General Assembly, justices of the State Supreme Court, or judges of the South Carolina Court of Appeals."
SECTION 2. The proposed amendment must be submitted to the qualified electors at the next general election for representatives. Ballots must be provided at the various voting precincts with the following words printed or written on the ballot:
"Must Section 8, Article XVII of the Constitution of this State, relating to the prohibition on public officers gambling or betting on games of chance, be amended so as to provide an exception that allows participation in lotteries conducted by the State of South Carolina by officeholders other than the Governor, Lieutenant Governor, other constitutional officers, members of the General Assembly, State Supreme Court justices, or Court of Appeals judges?
Those voting in favor of the question shall deposit a ballot with a check or cross mark in the square after the word 'Yes', and those voting against the question shall deposit a ballot with a check or cross mark in the square after the word 'No'."
