TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-3-430 SO AS TO PROVIDE THAT THE STATE LAW ENFORCEMENT DIVISION SHALL NOT RECORD A VIOLATION OF A PROVISION RELATING TO CARRYING AN INSUFFICIENT NUMBER OF PERSONAL FLOATATION DEVICES ON A BOAT OR WATERCRAFT IN ANY DATABASE USED TO GENERATE A PERSON'S STATE CRIMINAL RECORD OR A NATIONAL CRIMINAL RECORD.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 3, Chapter 3, Title 50 of the 1976 Code is amended by adding:
"Section 50-3-430. The State Law Enforcement Division shall not record a violation of a provision relating to carrying an insufficient number of personal floatation devices on a boat or watercraft in any database used to generate a person's state criminal record or a national criminal record."
SECTION 2. This act takes effect upon approval by the Governor.
