To whom was referred a Bill (H. 4877) to amend Section 40-56-10, as amended, Code of Laws of South Carolina, 1976, relating to the composition of the Board of Pyrotechnic Safety, etc., respectfully
That they have duly and carefully considered the same and recommend that the same do pass with amendment:
Amend the bill, as and if amended, by striking SECTION 1 in its entirety and inserting:
/ SECTION 1. Section 40-56-10(A) of the 1976 Code is amended to read:
"Section 40-56-10. (A) The State Board of Pyrotechnic Safety is composed of seven nine members appointed by the Governor. One appointee Two appointees must be employed by a local fire authority, one two must be a pyrotechnics retailer retailers, one must be a pyrotechnics wholesaler, one two must be a law enforcement representative representatives, and three two must be members of the public who shall not possess any pecuniary interest in any entity engaged in a business directly involving the sale of pyrotechnics. A seat on the board that remains vacant for sixty days must be filled through an appointment by the Chairman of the House Labor, Commerce and Industry Committee, and the Chairman of the Senate Labor, Commerce and Industry Committee." /

State Expenditure
This bill revises the membership requirements for LLR's Board of Pyrotechnic Safety. This bill does not change the total number of board members, nor does it alter the duties of the board. Therefore, this bill will have no impact on the general fund, other funds, or federal funds.

TO AMEND SECTION 40-56-10, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE COMPOSITION OF THE BOARD OF PYROTECHNIC SAFETY, SO AS TO REVISE THE MEMBERSHIP BY DESIGNATING ONE ADDITIONAL SEAT FOR A MEMBER WHO IS A PYROTECHNIC RETAILER AND ELIMINATING ONE SEAT DESIGNATED FOR A MEMBER OF THE GENERAL PUBLIC.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 40-56-10(A) of the 1976 Code, as last amended by Act 196 of 2010, is further amended to read:
"(A) The State Board of Pyrotechnic Safety is composed of seven members appointed by the Governor. One appointee must be employed by a local fire authority, one two must be a pyrotechnics retailer retailers, one must be a pyrotechnics wholesaler, one must be a law enforcement representative, and three two must be members of the public who shall not possess any pecuniary interest in any entity engaged in a business directly involving the sale of pyrotechnics. A seat on the board that remains vacant for sixty days must be filled through an appointment by the Chairman of the House Labor, Commerce and Industry Committee, and the Chairman of the Senate Labor, Commerce and Industry Committee."
SECTION 2. The seat on the Board of Pyrotechnic Safety held by the appointee whose term expired November 11, 2017, is the seat eliminated by SECTION 1 of this act.
SECTION 3. This act takes effect upon approval by the Governor.
