VERSIONS OF THIS BILL
TO AMEND SECTION 40-13-250, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO CONTINUING EDUCATION REQUIREMENTS FOR LICENSEES OF THE BOARD OF COSMETOLOGY, SO AS TO PROVIDE REQUIREMENTS CONCERNING SPECIFIC SUBJECTS OF INSTRUCTION, MANDATORY NUMBER OF HOURS, AND ACCEPTABLE COURSE PROVIDERS; AND TO MAKE THESE PROVISIONS APPLICABLE MARCH 11, 2020, TO COINCIDE WITH THE BEGINNING OF A NEW LICENSE RENEWAL PERIOD.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 40-13-250(A) of the 1976 Code is amended to read:
"(A)(1) The holder of an individual license issued by the board biennially, on such date as may be designated by the board, shall renew his license and pay the renewal fee and furnish proof to the board that he has completed continuing education approved by the board. Of these licensees:
(a) all persons licensed by the board as cosmetologists, nail technicians, and estheticians must show satisfactory evidence of having successfully completed three hours of instruction in regulations, health, safety, and sanitation during the preceding licensing year; and
(b) all persons licensed by the board as instructors must show satisfactory evidence of having successfully completed six hours of instruction during the preceding licensing year, of which:
(i) three must be hours in regulations, health, safety, and sanitation; and
(ii) three hours must be in teaching methodology.
(2) A person who has held a license for at least fifteen consecutive years and is sixty years of age or older or who has held continuous licensure for at least thirty years, is fifty years of age, and who has not been disciplined by the board is exempt from taking continuing education courses.
(3) A person only may obtain continuing education credit in regulation, health, safety, and sanitation from providers approved by the board. Teaching methodology hours may be taught by any professional and need not be taught by a provider approved by the board.
(4) Upon approval by the board and submission of an attendance form prescribed by the board, a person may obtain continuing education credit by attendance at trade show cosmetology-related instructional programs.
(5) The board may not require a licensee to complete any continuing education in addition to the number of credits required in item (1)."
SECTION 2. This act takes effect March 11, 2020.
