VERSIONS OF THIS BILL
TO AMEND ARTICLE 7, CHAPTER 3, TITLE 57 OF THE 1976 CODE, RELATING TO THE POWERS AND DUTIES OF THE DEPARTMENT OF TRANSPORTATION, TO PROVIDE THAT A ROAD, BRIDGE, OR OTHER HIGHWAY FACILITY SHALL NOT BE DEDICATED AND NAMED IN HONOR OF A LIVING PERSON, AND TO PROVIDE FOR THE REMOVAL OF THE NAMES OF CERTAIN INDIVIDUALS FROM A ROAD, BRIDGE, OR OTHER HIGHWAY FACILITY; AND TO AMEND CHAPTER 1, TITLE 10 OF THE 1976 CODE, RELATING TO PUBLIC BUILDINGS AND PROPERTY, TO PROVIDE THAT A PUBLIC BUILDING SHALL NOT BE DEDICATED AND NAMED IN HONOR OF A LIVING PERSON, AND TO PROVIDE FOR THE REMOVAL OF THE NAMES OF CERTAIN INDIVIDUALS FROM A PUBLIC BUILDING.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 7, Chapter 3, Title 57 of the 1976 Code is amended by adding:
"Section 57-3-612. (A) A road, bridge, or other highway facility pursuant to Section 57-3-610 shall not be dedicated and named in honor of a living person.
(B) For a road, bridge, or other highway facility that has been named after an individual as of July 1, 2020, the Department of Transportation must remove the name of the individual:
(1) upon the conviction of a crime by the individual; or
(2) if the individual was an elected state or local official, one year after the official's death, unless the General Assembly enacts a joint resolution to extend the current name."
SECTION 2. Chapter 1, Title 10 of the 1976 Code is amended by adding:
"Section 10-1-167. (A) A public building shall not be dedicated and named in honor of a living person.
(B) For a public building that has been named after an individual as of July 1, 2020, the Department of Administration or the naming authority, if named by a local body, must remove the name of the individual:
(1) upon the conviction of a crime by the individual; or
(2) if the individual was an elected state or local official, one year after the official's death, unless the General Assembly enacts a joint resolution to extend the current name."
SECTION 3. This act takes effect upon approval by the Governor.
