THE COMMITTEE ON EDUCATION AND PUBLIC WORKS

To whom was referred a Bill (H. 3051) to amend the Code of Laws of South Carolina, 1976, by adding Section 56-5-4072 so as to provide that a pick-up truck with a fifth, etc., respectfully

REPORT:

That they have duly and carefully considered the same and recommend that the same do pass with amendment:

Amend the bill, as and if amended, by striking SECTION 1 and inserting:

/SECTION    1.    Article 33, Chapter 5, Title 56 of the 1976 Code is amended by adding:

"Section 56-5-4072.    Notwithstanding another provision of law, for recreational purposes only, a pick-up truck with a fifth wheel assembly may not tow more than one separate trailing vehicle. The combination of vehicles subject to this provision may not exceed a length of seventy-five feet overall dimension, inclusive of front and rear bumpers and load carried on it. However, the final trailing vehicle with its load must weigh no more than 3,000 pounds."        /

Renumber sections to conform.

Amend title to conform.

State Expenditure

This bill prohibits a pick-up truck with a fifth wheel assembly from towing more than one separate trailing vehicle. Additionally, a combination of vehicles subject to this provision may not exceed a length of seventy-five feet in overall dimension, which is inclusive of front and rear bumpers and the load carried on it.

DMV indicates that any programmatic changes to ensure consumers are aware of the new provisions can be managed within current appropriations. Therefore, the bill will not have an expenditure impact on the general fund, other funds, or federal funds of the department.

A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-5-4072 SO AS TO PROVIDE THAT A PICK-UP TRUCK WITH A FIFTH WHEEL ASSEMBLY MAY NOT TOW MORE THAN ONE SEPARATE TRAILING VEHICLE, AND TO PROVIDE A MAXIMUM LENGTH FOR THIS COMBINATION OF VEHICLES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 33, Chapter 5, Title 56 of the 1976 Code is amended by adding:

"Section 56-5-4072.    Notwithstanding another provision of law, a pick-up truck with a fifth wheel assembly may not tow more than one separate trailing vehicle. A combination of vehicles subject to this provision may not exceed a length of seventy-five feet overall dimension, inclusive of front and rear bumpers and load carried on it."

SECTION    2.    This act takes effect upon approval by the Governor.
