VERSIONS OF THIS BILL
TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 1-11-498 SO AS TO ESTABLISH THE "GEORGE STINNEY FUND" FROM WHICH THE DEPARTMENT OF ADMINISTRATION SHALL OPERATE A GRANT PROGRAM TO COMPENSATE THE FAMILY OF A PERSON WHO WAS WRONGFULLY EXECUTED; AND TO APPROPRIATE TEN MILLION DOLLARS TO THE FUND.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 1, Chapter 11, Title 1 of the 1976 Code is amended by adding:
"Section 1-11-498. (A) There is created a subfund within the Department of Administration entitled the 'George Stinney Fund'. The fund must be used by the department to operate a grant program whereby the family of a wrongfully executed person may apply to receive a grant to compensate the family for the wrongful execution.
(B) A person is considered to be wrongfully executed if the person was executed by the State and subsequently is exonerated by a court of competent jurisdiction.
(C) Upon application, the department must award the family of a wrongfully executed person ten million dollars regardless of when the person was wrongfully executed."
SECTION 2. From the Contingency Reserve Fund there is appropriated ten million dollars to the George Stinney Fund within the Department of Administration established pursuant to Section 1-11-498.
SECTION 3. This act takes effect upon approval by the Governor.
