TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 23-1-250 SO AS TO PROVIDE A LAW ENFORCEMENT OFFICER WHO IS THE SUBJECT OF A LAW ENFORCEMENT OFFICER MISCONDUCT INVESTIGATION IS PROHIBITED FROM RETIRING FROM HIS LAW ENFORCEMENT AGENCY DURING THE COURSE OF THE INVESTIGATION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 1, Title 23 of the 1976 Code is amended by adding:
"Section 23-1-250. (A) Notwithstanding another provision of law to the contrary, after the effective date of this act, a law enforcement officer who is the subject of a law enforcement officer misconduct investigation is prohibited from retiring from the law enforcement agency in which he is employed during the course of the investigation.
(B) A person who becomes employed as a law enforcement officer after the effective date of this act must sign an acknowledgement of the provisions contained in this section."
SECTION 2. This act takes effect upon approval by the Governor.
