TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 23-1-250 SO AS TO PROVIDE IT IS UNLAWFUL FOR A LAW ENFORCEMENT OFFICER TO USE ANY CHEMICAL AGENT TO INCAPACITATE CERTAIN MINORS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 1, Title 23 of the 1976 Code is amended by adding:
"Section 23-1-250. It is unlawful for a law enforcement officer to use any chemical agent including, but not limited to, oleoresin capsicum, pepper spray, and tear gas to incapacitate a minor less than twelve years old."
SECTION 2. This act takes effect upon approval by the Governor.
