STATEMENT OF ESTIMATED FISCAL IMPACT

Explanation of Fiscal Impact

State Expenditure

This bill waives the requirement for school years 2021-22 and 2022-23 of Section 59-63-100(A)(3), which provides that students must have been taught in a home school setting for a full academic year prior to participating in interscholastic activity of a public school district. The bill allows eligible homeschool students that were enrolled in a public school for the beginning of either the 2019-20 or 2020-2021 school years to participate in interscholastic activity of a public school district.

State Department of Education. SDE indicates that this bill will have no expenditure impact on the agency since it does not alter the duties or responsibilities of the agency.

Local Expenditure

This bill waives the requirements for school years 2021-22 and 2022-23 of Section 59-63-100(A)(3), which requires students to have been taught in a home school setting for a full academic year prior to participating in interscholastic activity of a public school district. The bill allows eligible homeschool students that were enrolled in a public school for the beginning of either the 2019-20 or 2020-2021 school years to participate in interscholastic activity of a public school district.

While SDE indicates that this bill does not alter the duties or responsibilities of school districts, we anticipate that some homeschool students who were previously not eligible to participate in interscholastic activities will now be eligible to participate. Further, SDE does not have data on the number of homeschool students that currently participate in interscholastic activities at public school districts, but expects the number is a small percentage of the homeschool student population. Based on this assertion, although the number of students eligible under the waiver provided in this bill cannot be quantified, we expect the number will be small. Therefore, we expect any expenses associated with a potential increase in the number of homeschool students participating in interscholastic activities within public school districts to be minimal and to be managed within the existing budgets of the local districts.

A JOINT RESOLUTION

TO WAIVE CERTAIN PROVISIONS OF SECTION 59-63-100 OF THE 1976 CODE RELATING TO LIMITATIONS ON HOMESCHOOL STUDENT ELIGIBILITY TO PARTICIPATE IN PUBLIC SCHOOL INTERSCHOLASTIC ACTIVITIES FOR THE 2021-2022 AND 2022-2023 SCHOOL YEARS.

Amend Title To Conform

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    For the 2020-2021 and 2021-2022 School Years, the requirements of Section 59-63-100(A)(3) of the 1976 Code are waived for homeschool students as defined in Section 59-65-40, 59-64-45, or 59-65-47. For the purposes of this resolution, eligible students must have been enrolled in a public school for the beginning of either the 2019-2020 School Year or 2020-2021 School Year.

SECTION    2.    This joint resolution takes effect upon approval of the Governor.
