VERSIONS OF THIS BILL
A bill
to amend the South Carolina Code of Laws by adding Section 63-5-380 so as to prohibit the collection of personal information from children by operators of websites, online services, and online or mobile applications and to establish penalties.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 3, Chapter 5, Title 63 of the S.C. Code is amended by adding:
Section 63-5-380. (A) It is unlawful for any operator of a website, an online service, or an online or mobile application to collect personal information from a child who is a resident of the State of South Carolina.
(B) A violation by an operator of the requirements of this section is considered an unfair or deceptive act under Chapter 5, Title 39, and the South Carolina Unfair Trade Practices Act.
(C) For purposes of this section, "child" means an individual under the age of eighteen years.
SECTION 2. This act takes effect upon approval by the Governor.
