A bill

TO AMEND THE SOUTH CAROLINA CODE OF LAWS BY AMENDING SECTION 9-11-10, RELATING TO THE POLICE OFFICERS RETIREMENT SYSTEM DEFINITIONS, SO AS TO ADD THE CATAWBA INDIAN NATION TO THE DEFINITION OF "EMPLOYER"; AND BY AMENDING SECTION 9-11-40, RELATING TO APPLICATION TO BECOME AN EMPLOYER UNDER THE POLICE OFFICERS RETIREMENT SYSTEM, SO AS TO PROVIDE THAT THE CATAWBA INDIAN NATION CAN APPLY TO BECOME AN EMPLOYER UNDER THE SYSTEM.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1.   Section 9-11-10(17) of the S.C. Code is amended by adding a subitem to read:

   (d) Catawba Indian Nation.

SECTION 2.   Section 9-11-40(1)(a) of the S.C. Code is amended to read:

   (a) A county, municipality, the Catawba Indian Nation, or other political subdivision of the State, and an agency or department of a political subdivision or service organization referred to in Section 9-11-10(17)(c) in its discretion, may become an employer by applying to the board for admission to the system and by complying with the requirements of this section and the rules and regulations of the board. The application must set forth the requested date of admission, which must be the January first, or the April first, or the July first, or the October first next following receipt by the board of the application, except that in the case of any applications received before January 1, 1963, the requested date of admission may be July 1, 1962.

SECTION 3.   This act takes effect upon approval by the Governor.
