VERSIONS OF THIS BILL
A bill
TO AMEND THE SOUTH CAROLINA CODE OF LAWS BY ADDING SECTION 40-5-235 SO AS TO PROVIDE THAT LAWYERS LICENSED FOR MORE THAN FORTY YEARS WHO ARE FOUND TO HAVE NO WORKING KNOWLEDGE OF THE CONSTITUTION OF THE UNITED STATES OR THE CONSTITUTION OF THE STATE OF SOUTH CAROLINA MUST TAKE AND PASS THE UNIFORM BAR EXAMINATION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 3, Chapter 5, Title 40 of the S.C. Code is amended by adding:
Section 40-5-235. Upon a finding by the Commission on Lawyer Conduct or the Office of Disciplinary Conduct that any lawyer licensed and admitted to practice law in the state of South Carolina for more than forty years engaged in conduct that publicly demonstrates that he has no working knowledge of the Constitution of the United States or the Constitution of the State of South Carolina, the lawyer must take the Uniform Bar Examination and receive a score of 266 or higher.
SECTION 2. This act takes effect upon approval by the Governor.
