A bill

 

TO AMEND THE SOUTH CAROLINA CODE OF LAWS BY ADDING ARTICLE 4 TO CHAPTER 67, TITLE 15 SO AS TO ABOLISH THE DOCTRINE OF ADVERSE POSSESSION; TO REPEAL SECTIONS 15-67-210 THROUGH 15-67-260 RELATING TO ADVERSE POSSESSION; AND TO REPEAL ARTICLE 3 OF CHAPTER 3, TITLE 15 RELATING TO ACTIONS FOR RECOVERY OF REAL PROPERTY.

 

Be it enacted by the General Assembly of the State of South Carolina:

 

SECTION 1.  Chapter 67, Title 15 of the S.C. Code is amended by adding:

 

Article 4

 

Adverse Possession

 

    Section 15-67-280. The statutory and common law doctrine of adverse possession as a method of obtaining title to real property by exercising continuous, open, actual, notorious, and exclusive possession of the property for a specified period of time is abolished.

 

SECTION 2.  Sections 15-67-210 through 15-67-260 of the S.C. Code are repealed.

 

SECTION 3.  Article 3, Chapter 3, Title 15 of the S.C. Code is repealed.

 

SECTION 4.  This act takes effect upon approval by the Governor.
