Explanation of Fiscal Impact
State Expenditure
This bill provides clarifying language regarding the transfer of the states' veterans homes from DMH to DVA. This bill states that DVA shall adopt and execute criteria, policies, and procedures for admissions to and discharges from South Carolina veterans homes. Further, this bill states that DVA shall set and collect fees for residence in and services provided by the veterans homes and allows DVA to receive state and federal benefits charged by the veterans homes.
DVA currently has the structure and personnel in place to manage these responsibilities and has been doing so since the facilities transferred agencies on July 1, 2024. Therefore, this bill will have no expenditure impact for DVA.

TO AMEND THE SOUTH CAROLINA CODE OF LAWS BY ADDING SECTION 25-11-730 SO AS TO PROVIDE THAT THE DEPARTMENT OF VETERANS' AFFAIRS SHALL ADOPT CRITERIA FOR ADMISSIONS TO AND DISCHARGES FROM SOUTH CAROLINA VETERANS' HOMES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 11, Title 25 of the S.C. Code is amended by adding:
Section 25-11-730. (A) The Department of Veterans' Affairs shall adopt and execute criteria, policies, and procedures for admissions to and discharges from South Carolina veterans' homes.
(B) The Department of Veterans' Affairs shall set and collect fees for residence in and services provided by South Carolina veterans homes.
(C) The Department of Veterans' Affairs is authorized to receive, as full or partial payment of any fees charged by a South Carolina veteran home, the assignment of any state or federal benefit.
SECTION 2. This act takes effect upon approval by the Governor.
