A bill

 

TO AMEND THE SOUTH CAROLINA CODE OF LAWS by AMENDing ACT 1543 OF 1968, AS AMENDED, RELATING TO THE AUTHORITY OF THE GREATER GREENVILLE SANITATION DISTRICT TO CONTRACT TO PROVIDE SANITATION SERVICES TO THIRD-PARTIES NOT WITHIN THE DISTRICT, SO AS TO ELIMINATE THIS AUTHORITY, TO ELIMINATE THE AUTHORITY OF THE COMMISSION TO CHARGE PROPERTY TAX MILLAGE WITHIN THE DISTRICT, TO PROVIDE THE COMMISSION ONLY MAY CHARGE A SANITATION FEE, to provide the commission shall retire all general obligation bonds, to provide the commission only may issue revenue bonds, TO EXEMPT EXISTING CONTRACTS, AND TO PROVIDE EXISTING CONTRACTS MAY NOT BE RENEWED OR EXTENDED.

 

Be it enacted by the General Assembly of the State of South Carolina:

 

SECTION 1.  SECTION 5 of Act 1543 of 1968, as last amended by Act 761 of 1971, is further amended to read:

 

SECTION 5. (A) The commission shall not provide refuse, garbage, and trash collecting services outside of the geographic boundaries of the district.The commission may negotiate and contract with individuals or business, commercial and industrial establishments not within the district to provide refuse, garbage and trash collecting services to such parties upon terms and conditions agreeable to the parties, but shall not render services outside of the district at rates less than rates being paid for comparable services by individuals or business, commercial and industrial establishments within the district.

    (B) Effective January 1, 2026, the commission shall:

       (1) provide refuse, garbage, and trash collecting services only to single-family residential customers inside of the geographic boundaries of the district;

       (2) no longer charge property tax millage on property within the district and shall only charge a sanitation fee set by the county council;

       (3) retire all general obligation bonds; and

       (4) no longer issue bonds other than revenue bonds.

 

SECTION 2.  This act takes effect upon approval by the Governor and does not apply to contracts existing prior to the effective date of this act, however, no such existing contracts shall be renewed or extended past their existing termination date.
