    A Bill to amend the Code of Laws of South Carolina, 1976, by adding Chapter 35 to Title 11 so as to provide for the South Carolina Consolidated Procurement Code which includes policies and procedures for procurement and purchasing by the State of South Carolina and the other political subdivisions thereof and which includes provisions relating to assistance to minority businesses and state income tax credits for minority businesses; to amend Section 8-13-410, relating to a public employee's use of his official position for financial gain, so as to prohibit a public employee from participating in procurements where he has certain financial or other interests therein; to amend Section 8-13-420, relating to the giving or offering of compensation to influence actions of public officials or employees, so as to prohibit the giving of certain gratuities or kickbacks; to amend the 1976 Code by adding Section 8-13-500 so as to prohibit public employees from accepting employment with or representing any person who has a procurement contract with the governmental body with which such employee is employed and to prohibit businesses in which such employees have an interest from engaging in certain actions; to add Sections 8-13-510, 8-13-520 and 8-13-530 so as to provide certain civil and administrative remedies against employees and nonemployees who violate ethical standards and requirements; to amend Section 11-9-630, relating to the sale by the Budget and Control Board of property not in actual use, so as to delete the sale of personal property; to amend Section 11-9-650, relating to the kinds of funds which may be paid for property sold under Section 11-9-630, so as to provide that the proceeds from the sale of such property shall be deposited in the General Fund instead of the Sinking Fund of the State; to amend Section 24-1-250, relating to the authority of the State Board of Corrections to sell timber, so as to provide that funds derived from the sale of such timber shall be deposited in the General Fund of the State instead of to the account of the Department of Corrections; to amend Section 44-19-60, relating to the authority of the State Mental Retardation Department to sell timber, so as to provide that the proceeds from such sales shall be deposited in the General Fund of the State instead of used by the Department for permanent improvements; to amend Section 44-21-280, relating to the sale of timber by the State Mental Retardation Department, so as to provide that the proceeds derived from the sale of such timber shall be deposited in the General Fund of the State instead of to the credit of the Department; to amend Section 50-3-550, relating to the disposition of the proceeds of the sale of timber by the Wildlife and Marine Resources Department, so as to provide that such proceeds shall be deposited in the General Fund of the State instead of to the Division of Game of the Department; to amend Section 59-117-40, relating to the powers of the Board of Trustees of the University of South Carolina, so as to require the Board to make contracts and lease real and personal property consistent with the provisions of Chapter 35 of Title 11; to amend Section 59-119-80, relating to the expenditure and use of property by the Board of Trustees of Clemson University, so as to require such action to be in compliance with Chapter 35 of Title 11; and to repeal Sections 1-1-410 through 1-1-510, 1-5-40, 1-11-30 through 1-11-60, 1-11-120 and 1-11-150, Chapter 9 of Title 2, Sections 2-13-30, 8-13-480, 10-1-60, 10-1-80, 10-1-90, 10-1-120, 10-5-10 through 10-5-80, 11-25-210 through 11-25-250, 11-25-280, 11-25-290, 11-25-410, 11-25-420, 24-1-180, 24-1-190, 24-1-240, 24-3-120, 57-3-740, 57-5-1680, 57-5-1690, 57-5-1710, 59-67-430 and 59-67-560, Act 701 of 1976 and Act 606 of 1978, relating to contracts and purchases by state agencies and departments; public property under the charge of the Secretary of State; regulations and procedures for the purchase, supply and acquisition of property by the Budget and Control Board; authorization of the Budget and Control Board to sell surplus personal property; authorization of the purchasing and property division to purchase supplies for political subdivisions and colleges; payment of claims against the State; powers of the Legislative Council to compile and let bids for publishing Codes or Supplements and establishment of the Committee on Statutory Laws; contracting by public officials with governmental agencies without competitive bidding; the state electrician and engineer; competitive bidding required on certain public construction contracts; Department of Highways and Public Transportation and correctional institutions using their own labor; payment of balances due on public construction projects; construction and renovation of public buildings and other projects; contracts for printing; limitation of amount payable for printing; penalty when the public printer is not in compliance with certain provisions; approval by the Budget and Control Board of purchases of printing equipment, stationery and office supplies; purchases and competitive bidding by the Department of Corrections; disposal of products of prison farms and industries; authority of the State Board of Corrections to purchase or lease farms; authority of penal institutions to purchase prison clothing from the state penitentiary; the sale of unserviceable materials and equipment by the Department of Highways and Public Transportation; purchase of materials, supplies and equipment by the Department of Highways and Public Transportation over one thousand dollars and purchase of motor fuels and gasoline by the Department; adoption of purchasing system for new buses and sale of used school buses by the State Department of Education; establishment of the State Budget and Control Board as the single central broker for leasing real property for state agencies; and authorization of state agencies to negotiate architectural or engineering services not to exceed four thousand dollars.-at
