AN ACT TO AMEND SECTION 38-77-30, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO AUTOMOBILE INSURANCE DEFINITIONS, SO AS TO INCLUDE A NONOWNER INSURANCE POLICY WITHIN THE DEFINITION OF AUTOMOBILE INSURANCE; AND BY ADDING SECTIONS 56-1-245 AND 38-77-113 SO AS TO PROVIDE THAT WHERE A LICENSE IS SUSPENDED OR REVOKED DUE TO THE ABSENCE OF LIABILITY INSURANCE, THE LICENSE REINSTATEMENT FEE MAY BE WAIVED IF THE LICENSEE HAD LIABILITY COVERAGE.
Be it enacted by the General Assembly of the State of South Carolina:
Definitions
SECTION 1. Section 38-77-30(1) of the 1976 Code is amended to read:
"(1) `Automobile insurance' means automobile bodily injury and property damage liability insurance, including medical payments and uninsured motorist coverage, and automobile physical damage insurance such as automobile comprehensive physical damage, collision, fire, theft, combined additional coverage, and similar automobile physical damage insurance and economic loss benefits as provided by this chapter written or offered by automobile insurers. An automobile insurance policy includes a motor vehicle liability policy as defined in item (7) of Section 56-9-20 and any nonowner automobile insurance policy which covers an individual private passenger automobile not owned by the insured, a family member of the insured, or a resident of the same household as the insured."
Condition for waiver of license reinstatement fee
SECTION 2. The 1976 Code is amended by adding:
"Section 56-1-245. If a driver's license is suspended or revoked because the licensee is determined by the department to have no motor vehicle liability insurance, the director of the motor vehicle division of the
department shall waive the reinstatement fee imposed pursuant to Section 56-1-390 if the licensee had motor vehicle liability coverage when his license was suspended or revoked. The director shall document his reasons for waiving the fee in the records of the department."

SECTION 3. The 1976 Code is amended by adding:
"Section 38-77-113. Time effective
SECTION 4. This act takes effect upon approval by the Governor.
