    AN ACT TO AMEND SECTION 16-17-680, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO UNLAWFUL PURCHASE OF COPPER, SO AS TO PROVIDE THAT IT IS UNLAWFUL TO PURCHASE NONFERROUS METALS FROM A PERSON WHO IS NOT AN AUTHORIZED RETAILER OR WHOLESALER UNLESS THE PERSON IS A SECONDARY METALS RECYLCLER AND VERIFIES THE SELLER'S NAME AND ADDRESS, CERTAIN OTHER IDENTIFICATION REQUIREMENTS ARE MET, THE SECONDARY METALS RECYCLER MAY ONLY PURCHASE NONFERROUS METALS FOR CASH CONSIDERATION, PROCEDURES FOR WRITTEN HOLD NOTICES ARE CREATED WHEN LAW ENFORCEMENT HAS REASONABLE CAUSE TO BELIEVE THE NONFERROUS METAL IS STOLEN, TO DEFINE CERTAIN NECESSARY TERMS, TO PROVIDE AN EXCEPTION FOR ALUMINUM CANS, AND TO PROVIDE FOR PREEMPTION OF LOCAL ORDINANCES UNDER CERTAIN CIRCUMSTANCES; AND BY ADDING SECTION 16-11-523 SO AS TO PROVIDE THAT IT IS UNLAWFUL TO WILFULLY AND MALICIOUSLY CUT, MUTILATE, OR DEFACE REAL PROPERTY FOR THE PURPOSE OF OBTAINING NONFERROUS METALS, TO PROVIDE PENALTIES, AND TO PROVIDE CIVIL LIABILITY FOR THE VICTIMS OF THE ATTEMPTED THEFT OF NONFERROUS METALS. - ratified title
