AN ACT TO AMEND ACT 462 OF 1978, AS AMENDED, RELATING TO THE DEFINITION OF HANDICAPPED PERSONS AND PENALTIES FOR VIOLATION OF PARKING PRIVILEGES FOR THESE PERSONS, SO AS TO INCLUDE WITHIN THE DEFINITION OF HANDICAPPED ANY PERSON WHO IS DETERMINED BY THE SOCIAL SECURITY ADMINISTRATION OR THE VETERANS ADMINISTRATION TO BE TOTALLY AND PERMANENTLY DISABLED AND TO INCREASE THE PENALTIES FROM A FINE OF NOT MORE THAN FIVE DOLLARS TO A FINE OF NOT MORE THAN TWENTY-FIVE DOLLARS OR IMPRISONMENT FOR NOT MORE THAN THIRTY DAYS.
Be it enacted by the General Assembly of the State of South Carolina:
Definition
SECTION 1. Item (2) of Section 1 of Act 462 of 1978, as last amended by Act 97 of 1979, is further amended to read:
"(2) 'Handicapped' means any person who has an obvious physical disability that requires the use of a wheelchair, braces, walkers, or crutches, those who have lost the use of one or both legs, and those who suffer from lung disease to such an extent that they are unable to walk without the aid of a respirator or any person who is determined by the Social Security Administration or the Veterans Administration to be totally and permanently disabled. A licensed physician must certify that such total and permanent disability substantially impairs the ability to walk."
Penalties
SECTION 2. The last paragraph of Section 3 of Act 462 of 1978 is amended to read:
"Any person violating the provisions of this section is guilty of a misdemeanor and upon conviction shall be fined not more than twenty-five dollars or imprisoned for not more than thirty days."
Time effective
SECTION 3. This act shall take effect upon approval by the Governor.
