Deliberations were opened with prayer by the Chaplain of the House of Representatives, the Rev. Dr. Alton C. Clark as follows:

Almighty God, our Father, we come into Your presence with hearts filled with gratitude for the opportunities that are ours. Help us to think the thoughts, possess the hopes, and do the deeds which become us as children of the Heavenly Father. May we ever be true to the high principles upon which our great Nation was founded, ever holding high our enthusiasm for the best. In our knowledge that You are the Father of all, may there flow forth from us righteous judgments, fair dealings, peaceful endeavors, and brotherly love for all. And when we falter, enable us to hear Your Word: "Fear not, for I am with you; be not dismayed, for I am your God; I will strengthen you; yea, I will keep you".

Rep. J.C. JOHNSON proposed the following Amendment No. 2 (Doc. No. 0921o), which was adopted.

Amend the bill, as and if amended, page 3, by striking Section 62-5-310, as contained in SECTION 3, and inserting:

/"Section 62-5-310.     (A)     If an incapacitated person has no guardian and an emergency exists, the court may exercise the power of a guardian pending notice and hearing to be held within fourteen days. If an appointed guardian is not effectively performing his duties and the court further finds that the welfare of the incapacitated person requires immediate action, it may, with or without notice, appoint a temporary guardian for the incapacitated person for a specified period not to exceed six months. If the court makes preliminary findings that:

(1)     a physician has certified to the court, orally or in writing, that the person is incapacitated or the court has already determined incapacity exists pursuant to Section 62-5-303;

(2)     no guardian has previously been appointed, or the appointed guardian or temporary guardian is not effectively performing his duties; and

(3)     the welfare of the incapacitated person requires immediate action.

The court then, with or without notice, may appoint a temporary guardian in accordance with Section 62-5-311, or may exercise the powers of temporary guardian if no person appears to have authority to act on behalf of the incapacitated person and if an emergency exists as described in subsection (B).

(B)     For the purposes of determining whether an incapacitated person's need for health care is an emergency, emergency means that the delay occasioned by further attempts to locate an authorized person or by proceedings for appointment of a guardian would present a serious threat to the life, health, or bodily integrity of the incapacitated person, and:

(1)     No person authorized to make health care decisions for the incapacitated person is immediately available; or

(2)     More than one person is authorized to make health care decisions for the incapacitated person, and these authorized persons disagree on whether certain care must be provided.

(C)     The findings and appointments made by the court pursuant to this section when made without notice and hearing must be redetermined at a hearing with notice which must be held within fourteen days after the appointment of the temporary guardian.

(D)     A temporary guardian appointed subsequent to notice and hearing shall serve for a specified period not to exceed six months. A temporary guardian may be removed before the expiration of the specified period in the same manner applicable to a guardian as described in Section 62-5-307.

(E)     A temporary guardian is entitled to the care and custody of the ward and the authority of any a permanent guardian previously appointed by the court is suspended so long as a temporary guardian has authority. A temporary guardian may be removed at any time. A temporary guardian shall make any report reports the court requires. In other respects the provisions of this Code law concerning guardians apply to temporary guardians.

(F) A hearing concerning the need for appointment of a permanent guardian must be a hearing de novo as to all issues, before the court."/

Amend further, Section 62-5-311(B), as contained in SECTION 4, page 5, by striking item (3), beginning on line 4, and inserting:

/(1) (3)     the spouse of the incapacitated person;. A person who claims to be a common law spouse of the incapacitated person has the burden of proving that status in order to qualify for appointment as a guardian under this provision. A decision by the probate court regarding the status of common law spouse is invalid if contrary to the findings of the Family Court and is not final unless the Family Court finds that existence of a common law marriage;/

For a person who at the time of the imposition of the sentence is ineligible because of age to obtain a driver's license, the suspension required by this section does not begin until he is eligible to obtain a driver's license. For purposes of this section a prior offense is an offense for which the person was convicted, entered a plea of guilty or of nolo contendere, or forfeited bail within ten years before the last offense."/

Fees shall may not be charged for examination and review to determine if such the documents are subject to disclosure. Any person violating the provisions of this section shall be deemed is guilty of a misdemeanor and, upon conviction, shall must be punished by a fine of not more than one hundred dollars or be imprisoned for not exceeding more than thirty days.
