TO APPROVE REGULATIONS OF THE DEPARTMENT OF CONSUMER AFFAIRS, RELATING TO LICENSING STANDARDS FOR CONTINUING CARE RETIREMENT COMMUNITIES, DESIGNATED AS REGULATION DOCUMENT NUMBER 1433, PURSUANT TO THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976 CODE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The regulations of the Department of Consumer Affairs, relating to licensing standards for continuing care retirement communities, designated as Regulation Document Number 1433, and submitted to the General Assembly pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code, are approved.
SECTION 2. This joint resolution takes effect upon approval by the Governor.

This regulation governs the licensing standards for continuing care retirement communities. It sets initial and final licensing standards and fees; renewal licensing procedures and fees; procedures for resolving the questions as to the applicability of the State Continuing Care Retirement Community Act to individual facilities; the requirements for continuing care contracts and disclosure statements; regulatory requirements for multi-facility corporations and expansions of existing facilities; procedures to be followed in case of a change in ownership of a continuing care retirement community; requirements of financial responsibility; the framework for oversight of escrow accounts for entrance fees and reservations deposits; procedures for resolving complaints by residents; the types of forms of licenses to be issued by the Department of Consumer Affairs; and addresses the issues of administrative process before the Department.
