TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 57-5-880 SO AS TO PROVIDE THAT THE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION MUST DETERMINE WHETHER ANY FILL MATERIAL USED BY IT IS ENVIRONMENTALLY SAFE BEFORE USE AND MUST COVER THE AREA FILLED IMMEDIATELY.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 57-5-880. When, in the construction or repair of a highway, road, street, or drainage area by the department, it is necessary to use fill material, the department must first determine whether the material to be used is environmentally safe. The department shall consult with the Department of Health and Environmental Control to make this determination. After a determination that the fill material is environmentally safe, the department may use it and must cover the entire area filled immediately."
SECTION 2. This act takes effect upon approval by the Governor.
