The General Assembly of the State of South Carolina, begun and holden at Columbia on the second Tuesday in January, being the 14th day of the month.

Pursuant to the provisions of the Constitution, the members of the Senate assembled this day in the Senate Chamber at 12 o'clock noon.

The Senate was called to order by the PRESIDENT, the Honorable Nick A. Theodore.

Proceedings were opened with prayer by the Chaplain, the Reverend George E. Meetze, of Columbia, S.C., as follows:

Beloved, hear the words of the prophet Jeremiah to the Israelites in exile in Babylon, the modern Iraq (Jeremiah 29: 11):

Let us pray.

Lord God of our fathers, as we begin the second session of our 109th General Assembly, and as You lifted the hearts and spirits of the Israelites in the dark days of the Babylonian captivity, so lift our spirits as we live in a day of world-wide uncertainty and economic distress and philosophic confusion.

We claim the promise You gave the faithful when You said through Jeremiah, I have plans for you...plans for welfare and not evil... to give you a future... and a hope. We pray in the spirit of Him who taught us to pray... together:
"Our Father who art in heaven, Hallowed be Thy Name, Thy kingdom come, Thy will be done, on earth as it is in heaven. Give us this day our daily bread; And forgive us our trespasses, as we forgive those who trespass against us; And lead us not into temptation, but deliver us from evil, For Thine is the kingdom, and the power, and the glory, for ever and ever." On motion of Senator WILLIAMS, with unanimous consent, the Senate agreed that upon completion of the reading of the matters in the Box, that the Senate would proceed to select or change Senate floor seat assignments, select committee assignments for vacancies now existing and elect committee chairmen.

Mr. President and Members of the Senate:

I am hereby returning without my approval S. 1026, R. 255: AN ACT
TO AMEND ACT 1494 OF 1972, RELATING TO SPECIAL MAGISTRATES IN KERSHAW COUNTY, SO AS TO CHANGE THE NUMBER OF SPECIAL MAGISTRATES IN THAT COUNTY.

This veto is based upon an opinion of the Attorney General's Office dated September 27, 1990, which states in concluding:

It appears that the provisions of S. 1026 relating to the designation by the County Council of specific hours of duty of the special magistrates and the establishment of the bond required of these magistrates could be construed as conflicting with the uniformity requirements of Article V... Additionally, the provision authorizing the designation by the County Council of the hours of availability of the special magistrates could be construed as being in conflict with Article VIII, Paragraph 14 which as referenced has been construed to withdraw administration of this state's judiciary, which would include the magistrate's court, from local concern. Also, general law provisions have been enacted dealing with the provisions of S. 1026. Article III, Section 34(IX) prohibits the adoption of a special law where a general law can be made applicable.

Furthermore, I believe this act contravenes the purpose and intent of R. 806, S. 1 of 1988, Section 22-1-10 et seq. of the South Carolina Code which not only established a uniform system of terms and qualifications of magistrates in this State, it also provided a formula for the number of magistrates in each county. The governing bodies in each county rely on this to provide budgets for the administration of these summary courts. It is my understanding that the Kershaw County Council was unaware of this legislation and did not support it. Therefore, I am returning this act without my signature and urge the General Assembly to not override this veto of legislation that contravenes the "home rule" aspects of the magistrate provisions in state law.

ARC of S.C. has a membership of over 600 people, which includes family members, people with mental retardation, professionals and friends. It is the largest and oldest parent/volunteer/advocacy organization in the State devoted solely to improving the lives of people with mental retardation and their families.

The S.C. Human Service Providers is made up of executive staff of county Mental Retardation Boards and other organizations. These Boards are comprised of more than 1,000 citizen volunteers who provide direction and support for local county mental retardation programs serving 8,000 citizens with mental retardation.

We look forward to the Senators dropping in to meet us on January 30.

Whereas, on November 15, 1991, Governor Carroll Campbell announced his intention to appoint Senator James M. Waddell, Jr., of Beaufort to the South Carolina Tax Commission, effective January 17, 1992; and

Whereas, this appointment will bring to a close one of the most distinguished careers in the history of the South Carolina Senate; and

Whereas, Jim Waddell was first elected to the Senate in 1960 after having previously served in the House for four years and during his thirty-two years in the Senate, he served in many varied capacities and chaired a number of standing and other committees including, of course, the Senate Finance Committee; and

Whereas, as Chairman of the Senate Finance Committee and as a member of the State Budget and Control Board, he has helped guide this State through periods of economic prosperity and economic uncertainty. There can be no greater tribute to his stewardship of South Carolina's fiscal and financial health than the fact that we presently have the highest credit rating issued by the rating organizations to any state and have endured the present economic recession not without difficulty but certainly without the terrible tribulations that have occurred in so many other states which in some cases face deficits in the billions of dollars and significant tax increases necessary to balance the books; and

Whereas, Jim Waddell is a 1947 graduate of The Citadel with a B.S. degree in Civil Engineering which he earned when he returned to The Citadel after being called to active duty in 1943 while a cadet. He served his country in the European Theater during World War II with courage and valor earning numerous battle stars and decorations. During Senate debates, his remembrances of his World War II years always helped to entertain and enlighten the debate; and

Whereas, there also can be no doubt that he is one of the foremost champions of higher education in South Carolina. His service as trustee and Chairman of the Board of Trustees of Clemson University, and his service to the Medical University of South Carolina, to The Citadel, to the University of South Carolina, and to the other institutions of higher learning in this State is in a large measure responsible for improving the educational opportunities of many of our state's citizens who otherwise would not be able to attend college; and

Whereas, Jim Waddell also has a deep love of the outdoors which became apparent during the period when he served as Chairman of Senate Fish, Game and Forestry Committee. His residence in Beaufort and the beauty of the Low Country have made him particularly supportive of South Carolina's magnificent natural environment and wildlife. He was the force behind the State's implementation of the Coastal Zone Management Act, and served as the Chairman of the South Carolina Coastal Council from its inception until 1988. These years speak to his lifetime of service to the natural heritage of South Carolina; and

Whereas, the Senator from Beaufort also served as the first Chairman of the Governor's Joint Committee on Mental Health and Mental Retardation and as Chairman of the National Task Force for the Education of the Handicapped. In these roles he assumed the responsibility to become a national ambassador for the rights of the handicapped which included public education, visitation, and testifying in nearly every state of the nation on behalf of handicapped children; and

Whereas, the respect in which he is held is evidenced by many awards and honors including his being named Outstanding Senator of the Year by the Greenville News, the Soil Conservationist of the Year by the South Carolina Wildlife Federation, and the Legislator of the Year by the South Carolina Chamber of Commerce; and

Whereas, Jim Waddell understands the words duty and loyalty and no Senator has kept the dictates to listen quietly, to counsel wisely, to keep confidences discreetly, and to act courageously more than he; and

Whereas, it is with great sadness that his extraordinary career in the Senate now comes to a close, a career that has spanned so many years, that has witnessed so much change, that has endured some disappointment, and that has generated abundant hope; and

Whereas, the Senate will miss his standards of excellence, thoroughness, and efficiency, his courtesy and his humor. When historians look back on the South Carolina of the twentieth century and the leaders of our State during these exciting but demanding times, there can be no question the name of Jim Waddell will be at the top of the list along with the other great names of the Senate like Brown, Gressette, and Dennis; and

Whereas, his colleagues in the Senate, by this resolution, on their behalf and on behalf of his constituents and countless friends throughout our State would like to thank him for a job well done as he begins a new chapter in his life as a public servant of the people of South Carolina. Now, therefore,

Be it resolved by the Senate:

That the members of the Senate hereby express their appreciation and best wishes to Senator James M. Waddell, Jr., of Beaufort, for his extraordinary thirty-two year career as a member of the South Carolina Senate upon his leaving the Senate to become a member of the South Carolina Tax Commission.

On motion of Senator WILLIAMS, the Senate proceeded to elect Committee Chairmen.

On motion of Senator J. VERNE SMITH, with unanimous consent, Senator DRUMMOND was nominated as Chairman of the Committee on Finance.

Senator WADDELL seconded the nomination, moved that the nomination be closed, and that Senator DRUMMOND be elected by acclamation.

Senator DRUMMOND was elected Chairman of the Committee on Finance by acclamation.

On motion of Senator DRUMMOND, with unanimous consent, Senator HOLLAND was nominated as Chairman of the Committee on Fish, Game, and Forestry.
