A BILL

TO AMEND SECTION 4-18-30, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PENALTIES UNDER THE PROVISIONS OF LAW REGULATING WRECKERS AT THE SCENE OF ACCIDENTS, SO AS TO PROVIDE FOR A MAXIMUM FINE IN AN AMOUNT NOT TO EXCEED ONE THOUSAND DOLLARS, RATHER THAN NOT EXCEEDING TWO HUNDRED DOLLARS.

Amend Title To Conform

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 4-18-30 of the 1976 Code is amended to read:

"Section 4-18-30. If a wrecker company or a representative or agent of it proceeds to the scene in violation of any of the provisions of this chapter, the owner of the wrecker shall be deemed is guilty of a misdemeanor and, upon conviction,

shall must be fined in an amount not to exceed two hundred dollars or imprisoned for a term not to exceed thirty days punished as provided for by county or municipal ordinance. However, no county or municipal ordinance may impose a fine of more than five hundred dollars or imprisonment for a term of more than thirty days. Penalties provided for by county or municipal ordinance may include the revocation of any license issued to conduct business as a wrecker for a period not to exceed six months."

SECTION 2. This act takes effect upon approval by the Governor.
