Whereas, garlic (Allium sativum), a bulbous perennial plant of the lily family (liliaceae) was used in ancient and medieval times as a medicine and a charm, contains an antibiotic known as allium, and is known to have antiseptic and other healthful properties; and
Whereas, garlic is celebrated by gourmets and culinary artists around the world for its onion-like and pungent taste, and is a classic ingredient in the finest and most delicious cuisines of many nations; and
Whereas, garlic is native to Asia, grows wild in Italy and Southern France, has become popular in the United States, and is even known to be cultivated within the limits of the Town of Camden, County of Kershaw, State of South Carolina, where the flowering stalks stately arising above ground may be seen proudly bearing tiny bulblets and tasty blossoms, and where the membranous skin of the wondrous bulb below ground is known to enclose up to 20 delectable, delicious, edible bulblets called cloves; and
Whereas, like garlic, rodents of the family Sciuridae (order Rodentia), are found almost worldwide, in a variety of habitats, including forests, deserts, plains, and tundra, and even in trees growing within the limits of the Town of Camden, County of Kershaw, State aforesaid, where delicious garlic of the fresh, home-grown variety is said to be cultivated; and
Whereas, rodents of the family Sciuridae (order Rodentia), be they tree dwellers living in nests of twigs and leaves or in the hollow of trees, or be they ground dwellers living in holes or burrows, are most prolific and primarily vegetarian, are noted for their fondness for seeds, nuts, and most anything good to eat, and are so resourceful as to even supplement their diet with garlic, especially the fresh, home-grown variety when they can get it; and
Whereas, because the aroma of fresh, home-grown garlic is so powerful and delicious, and because its onion-like and pungent taste is simply too tempting, certain rodents of the family Sciuridae (order Rodentia), i.e., squirrels, living in the trees in Camden, have taken to eating garlic, stalks and all, by nibbling the flowering stalks down to the ground and by digging up and devouring the delicious bulbs and cloves; and
Whereas, any gardener thus relentlessly robbed of the fruits of his labor, and any gourmet so dedicated to the culinary arts that is consistently deprived of his delicious, savory garlic, by such boorish, selfish, inconsiderate, and troublesome neighbors, must be justifiably provoked; Now, therefore,
Be it resolved by the House of Representatives:
That the members of the House of Representatives of the State of South Carolina sympathize with the hard working gardener and hard pressed gourmet in question, and are of one mind that it ought to be unlawful for squirrels to eat garlic in the first place; but, failing that, should the gardener thus robbed resort to force in defense of his garden, or should the gourmet thus deprived take up arms to save his garlic, he, the gardener and gourmet in question, ought not thereafter be charged or held to answer, by game wardens or any other law enforcement authorities whatsoever, for hunting or shooting squirrels over bait!
Be it further resolved that a copy of this resolution be forwarded to the Honorable Robert J. Sheheen, Speaker of the South Carolina House of Representatives, renowned gardener and gourmet, and that it may be posted in or near his garden as full and fair warning to all trespassing squirrels and other four-legged, furry rodents who may have acquired a taste for garlic of the fresh, home-grown variety, in hopes that all offending squirrels concerned will jointly and severally heed this warning, and forever cease and desist from their unwarranted and unwelcome visits to the Speaker's garden, and leave his garlic alone.

Whereas, Dreher High School of Columbia in Richland County has sent decathlete teams of students from the eleventh and twelfth grades to the South Carolina Academic Decathlon at Coker College eight times and has won the competition seven of those eight times -- a truly superb school record; and
Whereas, Dreher High decathletes for 1993 include Alex Brenner, Marlene Bates, Andy Fiffick, Josh Kennedy, Abhijeet Joshi, Jeffrey Oakman, Jonathan Oakman, Andrew Rice, and Paul Wachter, and the team's coach is Ms. Susan Dillon; and
Whereas, the Dreher team has won the 1993 South Carolina Academic Decathlon at Coker College and is scheduled to leave for Phoenix, Arizona, to compete in a national academic decathlon; and
Whereas, these outstanding Dreher High School students and their excellent coach are highly deserving of recognition. Now, therefore,
Be it resolved by the House of Representatives, the Senate concurring:
That the members of the General Assembly of the State of South Carolina, by this resolution, congratulate the decathletes of Dreher High School of Richland County on winning the 1993 South Carolina Academic Decathlon at Coker College.

H. 3442 -- Rep. Cromer: A BILL TO ALLOW SCHOOL ADMINISTRATORS AND OFFICIALS TO CONDUCT SEARCHES OF STUDENT AREAS ON SCHOOL PROPERTY WITHOUT PROBABLE CAUSE.
The Committee on Judiciary proposed the following Amendment No. 1 (Doc Name L:\council\legis\amend\BBM\10469JM.93), which was adopted.
Amend the bill, as and if amended, by striking all after the enacting words and inserting:
/SECTION 1. Any person entering the premises of any school in this State shall be deemed to have consented to a reasonable search of his person and effects.
SECTION 2. Notwithstanding any other provision of law, school administrators and officials may conduct reasonable searches on school property of lockers, desks, vehicles, and personal belongings such as purses, bookbags, wallets, and satchels without probable cause.
SECTION 3. Notwithstanding any other provision of law, school administrators and officials may conduct reasonable searches of the person and property of visitors on school premises.
SECTION 4. No school administrator or official may conduct a strip search.
SECTION 5. This act takes effect upon approval by the Governor./

Keegan, Martin, Kelley, Witherspoon, Worley, Snow and Thomas: A BILL TO AMEND TITLE 59, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO EDUCATION BY ADDING CHAPTER 136 SO AS TO PROVIDE THAT COASTAL CAROLINA COLLEGE, A FOUR-YEAR REGIONAL BRANCH OF THE UNIVERSITY OF SOUTH CAROLINA, SHALL BECOME COASTAL CAROLINA UNIVERSITY ON JULY 1, 1993, AND SHALL BE A SEPARATE AND DISTINCT INSTITUTION OF HIGHER LEARNING OF THE STATE OF SOUTH CAROLINA, TO PROVIDE FOR A BOARD OF TRUSTEES WHICH SHALL GOVERN THE UNIVERSITY, TO PROVIDE FOR THE BOARD'S POWERS, DUTIES, AND FUNCTIONS, TO AUTHORIZE THE UNIVERSITY TO ISSUE REVENUE BONDS, AND TO PROVIDE FOR CERTAIN TRANSITIONAL PROVISIONS INCLUDING THE TRANSFER OF PERSONNEL, ASSETS, LIABILITIES, AND BONDED INDEBTEDNESS.
The Education and Public Works Committee proposed the following Amendment No. 1 (Doc Name L:\council\legis\amend\DKA\4504SD.93).
Amend the bill, as and if amended, by adding Section 59-136-505 immediately following Section 59-136-500 on page 10 to read:
/Section 59-136-505. (A) No later than June 30, 1995, the Budget and Control Board shall issue state institution bonds pursuant to Title 59, Chapter 107, on behalf of Coastal Carolina University to refund and defease all state institution bonds issued on behalf of the University of South Carolina which are the Series 1991B and Series 1992C State Institution Bonds. That portion of the State Institution Bonds to be refunded which were used to provide facilities at Coastal Carolina University shall be refunded by a series of state institution bonds issued on behalf of Coastal Carolina University and secured by pledge of the tuition fees from Coastal Carolina University. The remaining state institution bonds to be refunded shall be refunded from the proceeds of state institution bonds issued on behalf of the University of South Carolina and secured by pledge of tuition fees collected at the University of South Carolina.
(B) On or before June 30, 1995, Coastal Carolina University shall issue its revenue bonds to refund the Student and Faculty Housing Revenue Bonds, Series 1987, issued by the University of South Carolina and Student and Faculty Housing Revenue Bond Anticipation Notes, the proceeds of which were used to provide facilities at Coastal Carolina University. The proceeds from the refunding revenue bonds shall be applied to defease and refund the outstanding Series 1987 Bonds and Notes. On and after the date of issuance of all refunding bonds, the pledge of revenues derived from the operation of dormitory facilities at Coastal Carolina University shall be released from the pledge securing other student and faculty housing revenue bonds issued by the University of South Carolina.
(C) Pending the issuance of the bonds described in subsections (A) and (B) above, the Budget and Control Board and the State Treasurer shall take all action necessary to continue the application of tuition fees and dormitory revenues derived by Coastal Carolina University to satisfy all obligations of the University of South Carolina with respect to bonds issued to provide facilities at Coastal Carolina University.
(D) For purposes of Section 59-107-10, Coastal Carolina University is also considered an institution on behalf of which state institution bonds may be issued thereunder. The purposes for which state institution bonds may be issued on behalf of Coastal Carolina University shall include the refunding of state institution bonds issued on behalf of the University of South Carolina to provide facilities at Coastal Carolina University./
Amend the bill further, as and if amended, by striking Section 3, as contained on page 11 and inserting:
/SECTION 3. This act takes effect upon approval by the Governor./

The President announced that nominations were in order for a member of the Public Service Commission from the Fourth Congressional District.
Senator Holland, on behalf of the Screening Committee, stated that Robert G. Rowell and James W. Schempp had been found qualified for candidates for the Public Service Commission.
Representative HASKINS withdrew Mr. James W. Schempp as a candidate.
Representative CARNELL moved that the General Assembly reject the nominations for the Public Service Commission as submitted by the Public Service Merit Selection Panel.
Senator Leventis moved to table the motion to reject the nominations.
Representative FELDER: "Mr. President, I would respectfully raise the Point of Order that you cannot table the motion of rejection and I would bring to your attention that on June 4, 1980, this very Point was brought before the General Assembly, the Joint Assembly, and was discussed in great detail and at that time, the Lt. Governor was Nancy Stevenson and she put the question of rejection in a vote and each member of the Joint Assembly had the right to vote for the candidates or to reject which is their right under the Public Service Commission Law, 58-3-23, which states how nothing prevents the General Assembly from rejecting all candidates nominated. I submit to you that the thrust of Rep. Carnell's motion was a request to reject and any motion to table would be in effect tabling the act of voting which you can't do. We have an absolute right to vote and to reject."
Senator Leventis: "I understood that Rep. Carnell had made the motion to reject."
Representative FELDER: "It may be semantics, but the Point is that each individual person in here has an absolute right to vote for a candidate or the choice to reject. And it was really the same effect and I would like to be able, if we voted to table, even if the vote to table succeeded, I would raise the Point that I could then vote reject anyway."
Lt. Governor Theodore: "Rep. Carnell, let me ask you this, would your motion be to place in nomination the term of reject."
Representative CARNELL: "Mr. President, my motion was to reject the candidates that were sent up by the Merit Selection Panel. I would like to, before I withdraw that motion, say that the only reason that I read the two paragraphs was because it was a long report from the Screening Committee and I know that hardly any of you have seen the transcript from the Merit Selection Panel and we would be here all day if I read it, but if you would read it, you would quickly realize what the Screening Committee was saying, that they did not do the in-depth screening that they should have. So, Mr. President, at this time, I withdraw the motion, but I ask that the members vote reject when they vote on the candidates."
Representative BEATTY nominated Mr. Robert G. Rowell as follows:
"Thank you, Mr. President...Mr. President, Speaker of the House, ladies and gentlemen of the Joint Assembly...I rise this morning to accept an honor. That honor is the privilege to nominate Robert Rowell for the position of Public Service Commission. The previous discussions that we have had somewhat sidetrack if you will and somewhat mar this honor. There have been some requests that you vote for rejection and I know that this is supposed to be a nomination and I will get to that, but I won't be long. The purpose supposedly for rejection is the opportunity for this Body to consider someone who is more qualified than the nominees presented to us by the Merit Selection Panel. Ladies and gentlemen, I take issue with that. Let me tell you about my nominee, Robert Rowell. Robert Rowell is presently the mayor of Spartanburg. I have had the pleasure to serve with him while I sat on City Council there in Spartanburg. We had our differences, often we disagreed, but we were never disagreeable. But, I often found him and I always find him to be a man that you could always sit down with, someone you could talk to, discuss your differences with and if your argument was persuasive, he was not above changing, agreeing and assisting. But, if his position was stead-fast and he did not fine you to be persuasive, then he was stead-fast and he would cling to his position. He stayed there. Let's talk about qualifications. Ladies and gentlemen, if we were to create a model for the person that we would want to sit on the Public Service Commission, I think Bob Rowell would be it. This man has served as Chairman of Spartanburg County Council. As I said, he is the Mayor of Spartanburg. He has served as Assistant Chairman of the Insurance Commission in Florida. He is a man with immense experience and above all, ladies and gentlemen, he has actually served on a Public Utility for some six years. If you were to read the complete report in the Journal, you will find that the Journal spoke, the Committee spoke highly of Bob Rowell's qualifications. This is someone who is very familiar with public utilities, what they are supposed to be and how to deal with them and the terminology and this is a man that has experience in public life, in business, in government, in finance, you name it, and if we were looking for qualifications, we have it. This is one of the few times that we really have, in my opinion, from what I have been able to see, someone who goes to a commission with the skills to deal with what the commission does. This is one of the few times and to reject this opportunity would be a disservice to the state. To say that we want to reject the nominees for the simple reason that we want more qualified people flies in facing the facts. The facts are that Bob Rowell's integrity is above reproach and he is immensely qualified, both personally and professionally. If qualifications are what you are looking for, Bob Rowell is it. Mr. President, Mr. Speaker, ladies and gentlemen of the House, I nominate Robert Rowell for the position of Public Service Commission and I ask that you support him. Before I am finished, let me tell you this, if you know Bob Rowell, then I know that you want to second this. The Public Service Commission or the Merit Selection Panel has its problems, I will be the first to admit that. Their selection process has its problems, but is this the place to deal with this, is now the time. We are talking about electing a qualified individual, let's not muddy the water with the problems of the Merit Selection Panel. Thank you."

It does not have to be because of good old boys, good old girls, the Frog, or over in Sumter, or wherever you got or whatever little ax you have got to grind, it simply may be, Mr. President, by way of Parliamentary Inquiry, would you not agree, because the law gives us that right and would you not agree that if the law is wrong, which some of us believe it is not operating properly, and we are attempting to change the law, don't you think it would behoove any Senator or House member who is offended by the rejection opportunity to change the law. Wouldn't you agree with that?"
Lt. Governor Theodore: "Absolutely. Now, let's proceed to vote."
