TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-17-45 SO AS TO PROVIDE THAT ON JULY 1, 1994, EACH COUNTY SHALL COMPRISE A SINGLE SCHOOL DISTRICT, TO PROVIDE FOR THE MANNER IN WHICH THIS REQUIREMENT MUST BE IMPLEMENTED INCLUDING THE ABOLISHMENT OF SCHOOL DISTRICTS OF THIS STATE WHICH DO NOT COMPRISE AN ENTIRE COUNTY, AND THEIR MERGER INTO THE LARGER COUNTYWIDE SCHOOL DISTRICTS, AND TO PROVIDE CERTAIN EXCEPTIONS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 59-17-45. (A) On July 1, 1994, the school districts of this State which do not comprise an entire county are abolished and are merged into the larger countywide school district established by this section.
(B) On July 1, 1994, each county shall comprise a single school district, except that nothing herein shall prevent a portion of one county from being a part of a school district of another county. The General Assembly before July 1, 1994, by law applicable to a particular county shall provide for a board of trustees for each countywide school district, the manner of their election, and the manner in which each countywide school district must be funded, operated, and administered including what fiscal autonomy, if any, the district shall have.
(C) Any county on July 1, 1994, which comprises a single school district shall not be affected by the provisions of this section and its school district shall continue to operate in the manner provided by law.
(D) The assets, liabilities, and bonded indebtedness of a school district within a county merged into a larger countywide school district must be transferred to or assumed by the countywide school district in the manner the General Assembly shall provide."
SECTION 2. This act takes effect upon approval by the Governor.
