TO APPROVE REGULATIONS OF THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL, RELATING TO THE TITLE V OPERATING PERMIT PROGRAM, DESIGNATED AS REGULATION DOCUMENT NUMBER 1706, PURSUANT TO THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976 CODE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The regulations of the Department of Health and Environmental Control, relating to the Title V Operating Permit Program, designated as Regulation Document Number 1706, and submitted to the General Assembly pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code, are approved.
SECTION 2. This joint resolution takes effect upon approval by the Governor.

Regulation 61-62.70 of the Department's Air Pollution Control Regulations and Standards is being amended. The original Regulation 61-62.70, Title V Operating Permit Program, was promulgated to comply with federal law pursuant to the requirements of 42 U.S.C. 7661 and 40 C.F.R. 70. Additionally, 40 C.F.R. 70 contained some federal conditions that were discretionary for state adoption. The discretionary items include general permits, renewal and expiration of permits, operational flexibility, off-permit changes, insignificant activities, deferral of permits for non-major sources, and permit shields. This amendment incorporates the discretionary items and makes the state regulation consistent with the federal regulation.
