In all earnestness, Lord, we come at the very beginning of this Legislative Session seeking Your guidance and help - not just for today, but for all of our days ahead. Cause us confidently to know that when a need arises and there is a demand for greater wisdom than our own, that You are ready to prepare us for a new beginning. Grant us the unlimited faith in God which enables us to hear clearly Your words of assurance as spoken in the prophecy of Isaiah: "I have taken you by the hand and kept you." In his sure confidence, we face with courage the all tasks You have given us.

Undergird us by Your strength; uphold us by Your presence. Amen.

By copy of this letter I am serving copies of this Appeal on Speaker of the House, Robert J. Sheheen, on William B. DePass, Chairman of the State Board of Canvassers, and on Scott Elliott, attorney for Elsie Rast Stuart.

Because this Appeal is being mailed during the holidays, I am also forwarding a copy of the appeal to Speaker Sheheen at his law office in Camden, and on Mrs. Rast individually. A copy of this Appeal is also being mailed to the Orangeburg County Election Commission.

TO:     ELSIE RAST STUART, VOTERS OF S.C. HOUSE DISTRICT 96, AND ALL OTHER INTERESTED PARTIES:

YOU WILL PLEASE TAKE NOTICE that Normal E. Fogle, appellant, by and through his undersigned attorneys, will appeal and does hereby appeal the Order of the Board of State Canvassers dated December 17, 1992 and received by appellant on December 23, 1992 to the South Carolina House of Representatives.

This appeal is filed pursuant to S.C. Code Section 7-17-250 (1976). This appeal arises out of the protest of the outcome of the election for S.C. House District 96 held November 3, 1992, the mandatory recount held November 13, 1992, and the certification of election results by the Board of State Canvassers on November 16, 1992. The protest was heard November 25, 1992 and resulted in the Order now being appealed.

The appeal is made on the following grounds:

1)     The certified results of the election for S.C. House of Representatives District 96 were as follows:

Elsie Rast Stuart -     5285 votes

Norman E. Fogle -     5193 votes
The county totals were:     Lexington     Orangeburg

Stuart:     3156 votes     2129 votes

Fogle:     1640 votes     3553 votes

2) The election procedure utilized in the East Springfield Precinct of Orangeburg County was invalid and had the effect of altering the true results of the election. The certified results of the East Springfield precinct were as follows:

Elsie Rast Stuart -     111

Norman E. Fogle -     255

3)     East Springfield Precinct in Orangeburg County is a split precinct with some of the voters eligible to vote in House District 86 and some of the voters eligible to vote in House District 96. The poll workers for the East Springfield Precinct of Orangeburg County were provided with 400 ballots containing the House district 96 race and 250 ballots containing the House District 86 race. The list of eligible registered voters provided to the poll workers indicated which voters were to receive ballots for District 86 and which voters were to receive ballots for District 96. Disregarding proper procedure, the first 400 voters to appear at East Springfield Precinct on November 3, 1992, were provided with ballots exposing them to the House District 96 race without regard to which part of the precinct they resided in. The last 48 voters were provided with ballots exposing them to the House District 86 race. This improper procedure had the following results:

a)     Voters who should have been allowed to vote in the House District 96 race were denied the opportunity to do. Appellant established at the protest hearing that 32 voters who lived in House District 96 received ballots for House District 86.

b)     Voters who should have been allowed to vote in the House District 86 race were instead allowed to vote in the House District 96 race. Appellant established at the protest hearing that 159 voters who lived in House District 86 received ballots for House district 96.

4)     There were 448 votes cast in the East Springfield precinct of Orangeburg County. The certified vote totals reflect that there were 27 total votes cast in House district 86: Sharp - 27 and write-in - 3. The certified vote totals reflect that there were 367 total votes cast in House District 96: Stuart - 111; Fogle - 255; and write-in - 1. Therefore, 54 ballots did not vote in either House race. The following possibilities that adversely affect Fogle's total and the integrity of the election:

a)     Fogle should have received the vote of any House District 96 voter who voted a straight Democratic Party ballot. If a straight Democratic Party ballot was cast on a District 86 ballot, no vote was recorded and Fogle lost that vote.

b)     Stuart improperly received the vote of any person voting a straight Republican ballot if that person lived in District 86 and received a District 96 ballot.

c)     Some persons who would have voted for Fogle did not vote in a House race when they did not see his name on the ballot as an option.

5)     That the improper election procedures in the East Springfield precinct of Orangeburg County have the effect of bringing the election results in doubt.

6)     That the following well-settled rule of law in South Carolina, established by the State Supreme Court and consistently followed by the Board of State Canvassers over the years, requires that improper or illegal votes in an election must be subtracted from the winner. In this case, appellant alleges that there were 191 improper votes. The margin of difference is 92 votes. Therefore, subtraction of the improper votes from the winner's total would bring the results of the election into question. Even subtracting the improper votes from the winner's East Springfield totals would have the effect of bringing the election result into question.

7)     The Board misconstrued and misapplied the holding of the Supreme Court in Hill v. South Carolina Election Commission, 304 S.C. 150, 403 S.E.2d 309 (S.C. 1991). Hill is not applicable to this case because there were no misidentified voters on the list of eligible voters. Every voter was properly listed on the voter list compiled by the Orangeburg County Election Commission. Therefore, it was unforeseeable that the there would be a problem with voter identification.

8)     The Board's decision is contrary to S.C. Code Section 7-13-810 (1976, as amended) which prohibits challenges after the time that a voter receives a ballot.

9)     This appeal is made on the foregoing grounds and on any other grounds that may become apparent after a review of the transcript of the proceedings before the Board of State Canvassers.

WHEREFORE, based on the foregoing appeal, appellant requests that the South Carolina House of Representatives inquire into this matter, issue an order setting an appeal briefing schedule and such hearing as allowed by law, find the election results to be in doubt and order a new election and for such other and further relief as the South Carolina House of Representatives deems appropriate.

That the House of Representatives elect members to fill vacancies on the State Reorganization Commission on Wednesday, January 13, 1993, at 2 o'clock in the Hall of the House of Representatives.

On motion of Rep. G. BAILEY, with unanimous consent, the following was taken up for immediate consideration:

H. 3004 -- Rep. G. Bailey: A HOUSE RESOLUTION TO AUTHORIZE THE SOUTH CAROLINA JAYCEES TO USE THE BLATT BUILDING AND UNDERGROUND PARKING FACILITY OF THE CAPITOL COMPLEX ON SATURDAY AND SUNDAY, JANUARY 23 AND 24, 1993, TO REQUEST THE DIVISION OF GENERAL SERVICES TO PROVIDE FOR REASONABLE USE OF THE UNDERGROUND PARKING FACILITY AND THE BLATT BUILDING, AND TO ARRANGE FOR ASSISTANCE AND ACCESS BY THE STATE HOUSE SECURITY FORCES.

Be it resolved by the House of Representatives:

That the South Carolina Jaycees are authorized to use the Blatt Building and underground parking facility of the Capitol Complex on Saturday and Sunday, January 23 and 24, 1993, if the House is not in statewide session on those days, for the purpose of involving the Jaycees in the legislative process and for the purpose of conducting a model legislature.

Be it further resolved that the Division of General Services is requested to provide for the underground parking facility and the Blatt Building to be made available for reasonable use by the Jaycees and that the State House security forces provide assistance and access necessary for this meeting in accordance with previous procedures.

The Resolution was adopted.

Wilder and Baxley: A CONCURRENT RESOLUTION TO DESIGNATE WEDNESDAY, MARCH 24, 1993, AS "CHILDREN WITH DISABILITIES DAY", TO ENDORSE THE "B.A.C.-COFFEE DAY FOR CHILDREN WITH DISABILITIES" PROJECT AND OTHER OUTSTANDING PROGRAMS OF LIFE ABILITIES, SOUTH CAROLINA SOCIETY FOR CHILDREN AND ADULTS WITH DISABILITIES, INC., AND TO PROVIDE FOR A JOINT SESSION OF THE GENERAL ASSEMBLY AT 12:00 NOON ON WEDNESDAY, MARCH 24, 1993, AT WHICH TIME THE STATE LIFE ABILITIES AMBASSADORS AND THEIR PARENTS WILL BE PRESENTED TO THE GENERAL ASSEMBLY.

Whereas, Life Abilities has again embarked upon its most worthwhile project to raise funds for children with disabilities, culminating in the forty-first annual "B.A.C.-Coffee Day for Children with Disabilities" in South Carolina on Good Friday, April 9, 1993; and

Whereas, under the statewide leadership of Edwin W. Fisher, State Life Abilities President, and Pattie Just, State Campaign Chairperson, ably assisted by Lt. Jim McClary of SLED, State President and John L. Caudle, II, Executive Director of the South Carolina Law Enforcement Officers' Association, and Thomas L. Sponseller, Executive Director and Buford Hancock, State President of the South Carolina Restaurant Association, this program is destined to raise thousands of dollars to aid our very deserving children and assist them in overcoming their disabilities; and

Whereas, the "B.A.C." buttons go on sale Friday, March 26, 1993; and

Whereas, the "B.A.C." project and all other programs of Life Abilities deserve the support, merit, and praise of all citizens of the State. Now, therefore,

That Wednesday, March 24, 1993, is designated "Children with Disabilities Day" in South Carolina and that Gerald David Avant, son of Mr. and Mrs. James Avant of Georgetown County; Jennifer Jill Ayers, daughter of Mr. and Mrs. Doug Ayers of Anderson County; Crockett Buchanan, son of Ms. Sherry Buchanan of Spartanburg County; Idris Livingston, son of Ms. Betty Livingston of Richland County; and Alexander Thomas Sizemore, son of Mr. and Mrs. Anthony Sizemore of Sumter County, who have been chosen to serve as State Life Abilities Ambassadors, be presented to the General Assembly, along with their parents in a joint session in the Hall of the House of Representatives on Wednesday, March 24, 1993.

Be it further resolved that the General Assembly extends to Life Abilities and its many dedicated supporters its sincere wishes for continued success in its many constructive and compassionate programs on behalf of persons with disabilities.

Be it further resolved that a copy of this resolution be forwarded to Herman L. Shealy, Jr., Executive Director of Life Abilities, for distribution to the state chairmen of the various phases of the Life Abilities campaign and the "B.A.C." project, as well as to the state Life Abilities Ambassadors themselves.

Whereas, he was the product of a distinguished South Carolina family whose members devoted themselves to public service for generations; and

Whereas, he was a superb and highly skilled legislator who commanded the respect and deep admiration of his colleagues, rising to the high post of chairman of the Senate Finance Committee, member of the State Budget and Control Board, and president pro tempore of the Senate; and

Whereas, he labored tirelessly in numerous areas of legislative endeavors for the betterment of the lives of his fellow citizens of the Palmetto State, but he will probably be remembered, and appreciated, most of all in two areas -- the State's financial strength and security and the improvement and strengthening of the State's fish, game, and wildlife laws; and

Whereas, he was a distinguished and outstanding attorney with an excellent legal grasp of legislative and other matters and was admired by his fellow lawyers in South Carolina for his legal skills and ability; and

Whereas, although he sacrificed much to be a full-time governmental leader and dedicated public servant for decades, he yet found the time to be thoroughly devoted to his family, whose love and support enabled him, and encouraged him, to serve the State; and

Whereas, he was known for his patience and for his quiet but effective manner of getting things done, but, most of all, he was known and loved for his compassion for others; he never hesitated to help anyone in need, and the beneficiaries of his kindness and generosity over the years will forever be too numerous to count; and

Whereas, Rembert Dennis was a great and beloved leader, a true friend to us, his colleagues, and a remarkably talented and dedicated public servant who will be missed greatly by all the citizens of South Carolina, but we were all blessed to have known him and to have benefitted from his leadership. Now, therefore,

Be it resolved by the House of Representatives, the Senate concurring:

That the members of the General Assembly of the State of South Carolina, by this resolution, express profound sorrow at the death of former Senator Rembert C. Dennis, one of South Carolina's ablest and most distinguished leaders, and extend deepest sympathy to his wonderful family and his countless friends.
