H. 5160 -- Reps. T.C. Alexander and Graham: A CONCURRENT RESOLUTION SUPPORTING THE EFFORTS OF OCONEE COUNTY AND ITS OUTSTANDING CITIZENS TO BE DESIGNATED A "WORLD WAR II COMMEMORATIVE COMMUNITY" BY THE UNITED STATES DEPARTMENT OF DEFENSE.
Whereas, Oconee County and its outstanding citizens have officially applied to the United States Department of Defense in Washington, D.C., to be designated as a "World War II Commemorative Community"; and
Whereas, the good people of Oconee County have made application for this honor and designation under the name "Oconee County World War II Commemorative Community"; and
Whereas, Ms. Nan Jones, teacher at Seneca High School, is the committee chairperson; and
Whereas, among the planned commemorative events or activities for 1994 in support of the application, the Oconee committee will dedicate a special World War II flag, will hold a D-Day commemoration on June 6, and will sponsor ceremonies in recognition of all World War II veterans on November 11; and
Whereas, among the events or activities planned for 1995 in support of the application, the Oconee committee will hold a special Memorial Day program in May to honor the memory of the 145 Oconee soldiers killed in the Second World War, will sponsor a picnic in July to honor all surviving veterans of the war, and will pay special tribute and recognition in November to all living World War II prisoners of war who reside in Oconee County; and
Whereas, the year 1994 marks the fiftieth anniversary of the Allies' D-Day invasion of continental Europe, and the year 1995 will mark the half-century anniversary of the end of World War II -- a war in which the United States of America participated to make the world safe for democracy and to vanquish the forces of evil who were systematically destroying civilization; and
Whereas, the Oconee committee's efforts to obtain the designation of a World War II commemorative community reflect the patriotism of the citizens of that county and their realization that the hard lessons of the Second World War must never be forgotten; and
Whereas, we are pleased to encourage the citizens of Oconee County to move forward in their efforts to become a World War II commemorative community and consider this a very worthwhile endeavor which is greatly deserving of support. Now, therefore,
Be it resolved by the House of Representatives, the Senate concurring:
That the General Assembly of the State of South Carolina, by this resolution, supports the efforts of Oconee County and its outstanding citizens to be designated a "World War II Commemorative Community" by the United States Department of Defense.

Whereas, these associations encourage high standards of conduct and codes of ethics in the public interest and promote voluntary action as an effective means of meeting common challenges; and
Whereas, over five hundred eighty-three people hold individual membership in South Carolina associations with the direct economic impact of these associations in excess of sixty-two million dollars annually; and
Whereas, the South Carolina Society of Association Executives is celebrating its thirtieth anniversary in 1994. Now, therefore,

"(5) A member who retires after June 30, 1990, and who has completed at least twenty-five years of credited service shall receive a monthly retirement allowance which must be equal to one-twelfth of seventy-one and three-tenths percent of the current active salary of the respective position plus one-twelfth of two and sixty-seven hundredths percent of the current active salary of the respective position for each additional year of active service over twenty-five. The monthly retirement allowance may not exceed one-twelfth of ninety percent of the current active salary of the respective position."
Amend the bill further, as and if amended, by adding an appropriately numbered SECTION to read:
/SECTION ____. The provisions of this act shall take effect upon approval by the Governor. Application for recomputation of benefits for members already retired must be made before October 1, 1994, and any change in benefits must be prospective only./

"(b) When the director determines that the character and attitude of a prisoner reasonably indicates that he may be so trusted, it may extend the limits of the place of confinement of the prisoner by authorizing him to work at paid employment or participate in a training program in the community on a voluntary basis while continuing as a prisoner, provided that the director determines that:
(1) such paid employment will not result in the displacement of employed workers, nor be applied in skills, crafts, or trades in which there is surplus of available gainful labor in the locality, nor impair existing contracts for services; and
(2) the rates of pay and other conditions of employment will not be less than those paid and provided for work of similar nature in the locality in which the work is to be performed.
No prisoner's place of confinement may be extended as permitted by this subsection who is currently serving a sentence for or has a prior conviction of criminal sexual conduct in the first, second, or third degree, attempted criminal sexual conduct, assault with intent to commit criminal sexual conduct, criminal sexual conduct when the victim is his legal spouse, criminal sexual conduct with a minor, lewd act on a child, engaging a child for sexual performance, or spousal sexual battery."/

Amend the bill, as and if amended, by striking Section 59-103-10 of the 1976 Code, as contained in SECTION 1, and inserting:
/"Section 59-103-10. In order to serve as an advocate and to provide overview and oversight of the services provided by the public higher education institutions, there is created the State Commission on Higher Education. Two members must be appointed by the Governor from each congressional district upon the recommendation of the majority of the legislative delegation members from the district. Six members must be appointed by the Governor from the State at large with the advice and consent of the Senate. Members must be appointed for terms of four years and until their successors are appointed and qualify. No one is eligible to serve on the commission for more than two consecutive terms. A term served by a member which is less than a full four-year term must not be counted in determining when a member has served the maximum number of terms. No member may be an employee or member of a governing body of a public or private institution of higher learning in this State. The commission shall consist of twelve members appointed by the Governor. The membership must consist of one representative from each of the six congressional districts, two members from the State at large, three representatives of the public colleges and universities and one representative of the independent colleges and universities of South Carolina.
The membership of the Commission on Higher Education must be as follows:
(1) Six members, one each to represent the six congressional districts of this State. These six members must be appointed by the Governor upon the advice and consent of the Senate. Each of these members must be a resident of the congressional district they represent and meet the minimum qualifications provided herein. In order to qualify for appointment, the representatives from the congressional districts must have experience in at least one of the following areas: business, the education of future leaders and teachers, management, or policy. Members representing the congressional districts may not be, or ever have been a member of a governing body of a public institution of higher learning in this State and must not be employed or have immediate family members employed by any of the public colleges and universities of this State. These members must be appointed for terms of four years and shall not serve on the commission for more than two consecutive terms.
If the boundaries of the congressional districts are changed, members serving on the commission shall continue to serve until the expiration of their current terms, but successors to members whose terms expire must be appointed from the newly defined congressional districts. If a congressional district is added, the commission must be enlarged to include a representative from that district.
(2) Two members appointed from the State at large for terms of four years each. One of these two members must be appointed chairman of the commission by the Governor to serve a term as chairman coterminous with that of the Governor.
(3) Three members to serve ex officio to represent the public colleges and universities. One member must be serving on the board of trustees of one of the following public senior research institutions: Medical University of South Carolina, Clemson University, and University of South Carolina. One member must be serving on the board of trustees of one of the following four-year or two-year public institutions of higher learning: Francis Marion University, Coastal Carolina University, Lander University, Winthrop University, The Citadel, South Carolina State University, College of Charleston, University of South Carolina-Spartanburg, University of South Carolina-Aiken, University of South Carolina-Beaufort, University of South Carolina-Lancaster, University of South Carolina-Salkhatachie, University of South Carolina-Sumter, and University of South Carolina-Union. One member must a member of one of the local area technical education commissions to represent the State Board for Technical and Comprehensive Education. These members must be appointed to serve terms of two years. No institution may be represented for more than one consecutive term.
(4) One ex officio member to represent the independent colleges and universities. The individual appointed must be serving as a member of the Advisory Council of Private College Presidents. This member must be appointed for a term of two years, may not serve more than two consecutive terms, and shall serve as a nonvoting member.
The Governor, by his appointments, shall assure that various economic interests and minority groups, especially women and blacks, are fairly represented on the commission and shall attempt to assure that the graduates of no one public or private college or technical college are dominant on the commission. Vacancies must be filled in the manner of the original appointment for the unexpired portion of the term. All members of the commission shall serve until their successors are appointed and qualify. The chairman of the commission must be elected annually by the members of the commission and may not serve as chairman for more than four consecutive years. Members recommended by the General Assembly must be residents of the appropriate congressional district. If the boundaries of congressional districts are changed, members serving on the commission continue to serve until the expiration of their terms, but successors to members whose terms expire must be appointed from the newly defined congressional district. If a congressional district is added, the commission must be enlarged to include representation from that district."/

Amend the bill, as and if amended, page 2, line 41, by striking subsection 2 in its entirety and inserting in lieu thereof the following:
/(2) Three members to serve ex officio to represent the public colleges and universities. One member must be serving on the board of trustees of one of the following public senior research institutions: Medical University of South Carolina, Clemson University, and University of South Carolina. One member must be serving on the board of trustees of one of the following four-year public institutions of higher learning; Francis Marion University, Coastal Carolina University, Lander University, Winthrop University, The Citadel, South Carolina State University, College of Charleston, University of South Carolina-Spartanburg, and University of South Carolina-Aiken; provided, that if the representative for this group of schools is chosen from either the University of South Carolina-Spartanburg or the University of South Carolina-Aiken, the representative must be chosen from the local area higher education commission rather than a board of trustees; provided, further, that the representative may not be chosen from either the University of South Carolina-Spartanburg or the University of South Carolina-Aiken when the research institution represented on the board is the University of South Carolina. One member must a member of one of the local area technical education commissions to represent the State Board for Technical and Comprehensive Education. These members must be appointed to serve terms of two years. No institution may be represented for more than one consecutive term./
