TO AMEND SECTION 56-3-120, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO EXEMPTIONS FROM THE VEHICLE REGISTRATION AND LICENSING REQUIREMENT, SO AS TO EXCLUDE LAWN AND GARDEN TRACTORS AND CONSTRUCTION EQUIPMENT FROM THE EXEMPTION; TO AMEND SECTION 56-3-240, RELATING TO THE CONTENT OF AN APPLICATION FOR VEHICLE REGISTRATION AND LICENSING, SO AS TO EXEMPT OWNERS OF LAWN AND GARDEN TRACTORS AND CONSTRUCTION EQUIPMENT TRANSFERRED FROM A PREVIOUS OWNER FROM COMPLETING THE ODOMETER DISCLOSURE STATEMENT; BY ADDING SECTION 56-3-642 SO AS TO PROVIDE THE FEE FOR OBTAINING A TITLE AND REGISTERING LAWN AND GARDEN TRACTORS AND CONSTRUCTION EQUIPMENT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 56-3-120 of the 1976 Code is amended to read:
"Section 56-3-120. The following vehicles shall be are exempt from registration and licensing under this chapter:
(1) Any such a vehicle driven, operated, or moved upon a highway in conformance with the provisions of this chapter relating to nonresidents or under temporary permits issued by the department as herein authorized;
(2) Any an implement of husbandry, excluding lawn and garden tractors, whether of a type otherwise subject to registration and license which is only incidentally operated or moved only incidentally upon a highway;
(3) Any a special mobile equipment vehicle, excluding construction equipment, which is only occasionally moved only occasionally over a highway and every such a special mobile equipment vehicle of the State, any department or agency thereof or its departments, agencies, or any of the political subdivisions of the State, their departments and agencies; and
(4) Any such a vehicle owned and operated by the government of the United States."
SECTION 2. Section 56-3-240 of the 1976 Code is amended to read:
"Section 56-3-240. (A) Every such An application shall must contain:
(1) the name, bona fide residence, and mail address of the owner or business address of the owner if a firm, association, or corporation and the county, municipality, if applicable, and school district in which the applicant resides;
(2) a description of the vehicle including insofar as such data may exist with respect to a given vehicle, as applicable, the make, model, type of body, number of cylinders, serial number, and engine or other number of the vehicle, whether the vehicle is new or used, and the date of sale by the manufacturer or dealer to the person intending to operate such a vehicle and, in the event. If a vehicle is designed, constructed, converted, or rebuilt for the transportation of property, a statement of the load capacity for which it is to be registered must be included;
(3) Such further other information as may reasonably be required by the department to enable it to determine whether the vehicle is lawfully is entitled to registration and licensing;.
(4)(B) In addition to the information required by item (2) of subsection (A), whenever the application is for a motor vehicle which has been transferred from a previous registrant to the applicant, the applicant will shall complete the odometer disclosure statement on the application which shall must read:
`I certify that the odometer reading is ________ miles/kilometers (indicate one) Check one only:
-To the best of my knowledge, the odometer reading stated reflects the actual cumulative distance traveled by the vehicle described herein.
-The odometer reading stated is in excess of 99,999.
-The odometer reading stated does not reflect the actual cumulative distance traveled.
Under the terms of the Federal Motor Vehicle Information and Cost Savings Act and applicable state law, incorrect information may result in civil liability and civil or criminal penalties.'
This provision does not apply to lawn and garden tractors and construction equipment."
SECTION 3. The 1976 Code is amended by adding:
"Section 56-3-642. The title and registration fee for lawn and garden tractors, and construction equipment contained in Section 56-3-120 is ten dollars. This fee is assessed each time the vehicle is transferred from one individual to another individual."
SECTION 4. This act takes effect upon approval by the Governor.
