AN ACT TO PROVIDE A MINIMUM DISTANCE WITHIN WHICH A COMMERCIAL CONSTRUCTION, DEMOLITION, AND LAND-CLEARING LANDFILL IN SPARTANBURG COUNTY MAY NOT BE LOCATED FROM AN EXISTING AQUACULTURE FARM OR FACILITY AND TO PROVIDE EXCEPTIONS AND DEFINITIONS.
Be it enacted by the General Assembly of the State of South Carolina:
Landfill Location
SECTION 1. Notwithstanding any other provision of law, no commercial construction, demolition, and land-clearing landfill in Spartanburg County may be located within three thousand feet of an existing aquaculture farm or facility. This section does not apply to existing permitted commercial construction, demolition, and land-clearing debris landfills. For purposes of this section, "commercial landfill" means a landfill providing landfill services to other persons or entities for compensation.

SECTION 2. This act takes effect upon approval by the Governor.
