TO CREATE THE OCONEE COMMUNITY THEATRE AUTHORITY, PROVIDE FOR ITS RESPONSIBILITIES, MEMBERSHIP OF THE AUTHORITY, TERMS, OFFICERS, COMMITTEES, REQUIRE THE AUTHORITY TO PROPOSE AND ADOPT A BUDGET, AND THE RULES OF THE ORDER UNDER WHICH THE AUTHORITY MUST OPERATE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. (A) There is created the Oconee Community Theatre Authority.
(B) The Oconee Community Theatre Authority shall receive and expend funds for the building of the Oconee Community Center to be located in Seneca, South Carolina. The purpose of this authority is ownership, construction, and operation of the Oconee Community Complex.
SECTION 2. It is the responsibility of the authority to:
(1) collect and receive funds for the building of the Oconee Community Complex;
(2) build the Oconee Community Complex;
(3) own and operate the Oconee Community Complex upon completion of the building of the complex.
SECTION 3. The authority is composed of twelve members. The City of Seneca has the right to appoint a proportionate share of the members of the authority based upon the percentage of the grant from the City of Seneca to the total cost of the construction of the Oconee Community Complex. The remaining members of the authority must be appointed by the Oconee Community Theatre.
SECTION 4. The terms of office for members of the authority are for three years. The terms must be staggered to provide for the appointment of four new members each year. This term begins on the first Monday of October in each year. The termination of the four one-year terms and the four two-year terms from the initial membership of the authority must be accomplished by the drawing of straws at the first meeting. Any member of the authority may succeed himself.
SECTION 5. Immediately upon the appointment of the authority, it must be organized by an executive committee to be composed of a chairman, vice chairman, secretary, and treasurer. The term of each office is for one year, and no officer shall serve in the same capacity for more than three six consecutive terms.
SECTION 6. The executive committee shall create and the chairman of the authority shall appoint those committees deemed necessary to further the purposes and execute the needs of the authority. These committee members need not be members of the authority.
SECTION 7. The authority shall propose and adopt its budget under direction of its members. The authority shall seek funds for its operation and projects from any and all legitimate sources including city, county, state, and federal governments; local, regional, and national business establishments; foundations; and citizens of the community. The authority has the ability to solicit and receive funds and expend funds in the furtherance of its purpose.
SECTION 8. Meetings of the authority must be conducted according to Robert's Rules of Order. A quorum shall consist of a majority of the members of the authority, and a quorum must be present to officially conduct business. Minutes of authority meetings must be kept in written form and passed from chairman to chairman.
SECTION 9. This act takes effect upon approval by the Governor.
